10 months after my initial claim I am happy to report I have received the full amount claimed in my bank account. :beer:
Details for anyone else on the flights -
TCX 2994 Manchester - Antalya 13/08/2012 6 hour delay
TCX 2995 Antalya - Manchester 27/08/2012 6 hour delay
Initial claim rejected, went to CAA, waited, got email back in September finding TC liable. Delaying tactics still employed by TC right up until last week when out of the blue got email offering voucher. Rejected that and got paid cash via bank transfer yesterday.
Maybe the CAA aren't quite the chocolate teapot some on here make out eh?0 -

Whilst one swallow does not a summer make, have we noticed - anecdotally - the CAA ruling on more of these in the passengers favour? Small numbers for sure, but where they have done so it seems to be - from the few examples reported here - on the "all reasonable measures" test.
All that said, the airlines seem systematically to be ignoring any CAA ruling that supports the passenger. (Gorses' experience is quite atypical.). So given a) the very long time it takes to get a view from them (just shy of a year on average it seems), b) the likelihood that the CAA will find against you, despite what the law actually says, and c) the fact that the airlines will almost certainly ignore any positive response, I still cannot recommend that people engage the CAA. It remains a waste of time, IMHO.0 -

I'm looking for some advice. I sent off the template letter on here on the 25th February for my flight delay on 23rd September 2012 from larnaca to Cardiff which was delayed for 32 hours.
The letter template states that you would like a response within 14 days or the matter can be taken further. Would it be best to wait a few more weeks or would you go to the CAA
The delay was due to a fault in the engine whilst about to take off.

I emailed my claim for compensation following a 4 and half our return flight delay from Majorca to Birmingham.
I have received an e-mail today from Thomas Cook stating they will send me a voucher for compensation for £335 per person. i have received a voucher for the total of £1,005 (which equates to 3 x £335.) There were 4 people in my party which I did state in my letter, the yougest being 4 years old.
I did have a free child place - could that be why they have only paid out for 3 of us?
Also, do I have to accept payment in the form of a voucher which they have already e-mailed to me. Surely they can't stipulate where and how I spend my compensation payment ?
Any advice would be greatly appreciated.:beer:Nicky

You paid for 4 passengers, no such thing in reality as a child flying free IMHO, but a small claims judge may not agree.

My daughters claim for a five hour flight delay in 2012 from Manchester to Dalaman has been rejected twice now by TC on grounds of exceptional circumstances. The CAA sent it back to them for reconsideration but still TC have refused it.
Where next? I think she should take court action for the 800.00 for her and her friend but has this been tested?

Not sure what you mean. Even if they have paid out others on the flight that doesn't count for anything (well, very little). If you read the FAQs you'll be able to get some idea of what the prospects are for a successful claim and, if appropriate, how to progress it.0
