Hi, just signed up to put my details of my claim in here incase it's of help to anyone else..
Got delayed going from manchester to Kos on the 12/9/2013, flight number tcx2416. We were delayed 5 hours in manchester airport.
Read about claiming compensation on another forum, did some more reading online expecting to have a real battle on our hands with Thomas Cook. Couldn't have been more wrong though.
I went on the Thomas Cook website and filled in the eu261/2004 form with our details expecting to get a response trying to fob us off. A week later got an email admitting fault and offering us £682 holiday vouchers between us, i replied stating that I wanted a cash transfer along with my bank details, they then emailed me back as I missed a couple of bits they needed for the transfer, sent them off and now the transfer has been arranged and I'm just waiting for it to land in my bank account.
Seems like I'm one of the lucky ones after reading some of the horror stories in here but thought I should put up my story as it's been pretty stress free all in all and hopefully some other people might see this who were on the same flight.0 -
I still cannot recommend that people engage the CAA. It remains a waste of time, IMHO.
I think this forum should stop recommending NWNF over the CAA route though. That's potentially costing people money.
If somebody doesn't want want to (or isn't able to) put in hours++ of forum reading, their own money for fees plus the stress of a court case then why not ask the CAA in rule and sit back and forget about it for 6 months?0 -

Er, because the CAA rule against the passenger in the majority of cases, not least because they believe that technical problems ARE extraordinary circumstances. So if you go before the CAA the chances are that either a) they ignore you, or refer it back to the airline; b) if they rule at all, they are more likely to rule against you than the airline, which may hobble your case if you take it to court; and c) if the small number of instances (like yours) where they rule in the passengers' favour, the airlines generally ignore it and force the passenger to go to court anyway.
Your experience is very rare. It's not a good basis on which to make recommendations to other, in my view.0 -

I don't think anyone recommends no win no fee lawyers as such. They are suggested as a route for people who don't wish to handle their own case.
Criticism of the CAA appears, as far as I can see, to be based wholly on the cumulative reported experience of posters.
The definitive advice given on here is to read the FAQs and relevant threads. We're all grown ups and should make our own decisions based on our own reading/research.0 -
To clarify. I think we have exhausted the TC and CAA route. CAA won't rule they will only pass the case back to the airline to be reconsidered.
That done the airline still claim exceptional circumstances.
the flight was delayed due to a technical issue caused by the inbound flight and by so TC claim a baggage fault at T1 which resulted in baggage having to be transferred to T2 for screening.
A number of factors.
Now we've reached the end of the line I'm going to escalate this to court action but has anyone done this in similar circumstances?
what was your experience?
