    I've just had a response from Thomas Cook see below-
    We were delayed 21hrs due to a technical fault and the airline were waiting for parts to come over to malta to be fitted to the plane, if anyone thinks I have a case can you please advice as to what I should do next, thanks in advance.

    I am writing in response to your email regarding your past travel arrangements with Thomas Cook.


    Initially, I would like to apologise for the disruption to your flight plans. Please be assured that a lot of work goes on behind the scenes to ensure that any delays are kept to an absolute minimum, as we do fully understand the inconvenience and frustration these can cause.


    It is not always immediately apparent as to when a revised take off time can be secured and a number of factors have to be considered, which quite often rely on outside influences, such as Airport Authorities or Air Traffic Control. We do appreciate the importance of communication, and I would assure you that information is passed onto our customers as quickly as possible, through our handling agents at the airport.


    Having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature. These were extraordinary, in that Thomas Cook took all reasonable precautions necessary to avoid the situation, and despite our proactive measures the problem could not have been prevented. All our aircraft are maintained to a very high standard, in line with CAA regulations, however, despite these steps, mechanical failures can arise without prior warning. These unpredictable events can be likened to those we encounter with our own cars, despite having full service histories, or MOT’s.


    In line with Regulation 261/2004 a payment of compensation would not be considered applicable in this case.


    Please be assured that on-time performance is a key measure for us as a business, and we constantly review our operations to ensure we deliver the best results, and service. !I would like to offer our apologies for any inconvenience you were caused on this occasion and I hope that despite this, your stay was found to be an enjoyable one.

    You need to quote actual date and flight number.
  • Thomas Cook have sent me a £505 voucher after my flight back from Florida to Manchester was delayed by 4 hours last June. Does anyone know if they are trying to pull a fast one by giving me a voucher? Should I claim cash instead?

    seriuosly, let me explain

    Has you have already guessed I have not got a clue what I’m doing.
    I first started by searching the net high and low looking for similar cases but found none but the deeper I dug the more confusing it got trying to understand the legal jargon. This is when I realised I was out of my depth.
    I then came on this forum to find someone who may have had a similar experience as myself or better find someone who may have even been on the same flight. Not knowing I wrongly posted on a few forums, threads or whatever they are called. Has I couldn’t find anything similar I hoped people like yourselves who has experience could step in. I had no intention of wanting the leg work done for me for if this was even to go to court I would have to be represented.
    My initial letter to TC was for tec fault, and then I wrote to say I thought it could be denied boarding, and then I scratched my head and thought it’s none of those. Somewhere along the lines “operational decision “came up. I googled that with flight delay still nothing.
    All I was ever looking for on this forum was help off people who had a better understanding of these matters by letting me know if you thought I had a cat In hells chance and if so what could I possibly put my delay come under

    You have a good chance but from the sound of things research is not your strong point therefore I reiterate that I feel you would be best to run with a no win no fee firm but the choice is yours.

    That's fair enough; it only makes some sense to me because I have some experience of reading and interpreting legislation.

    The point is that the information you appear to be looking for is in the FAQs etc..

    You say "if this was even to go to court I would have to be represented". That's the point. Either you have to do that yourself or pay someone. If you are not finding it easy to digest the information in the forum, you will probably find it difficult to put together and present a (successful) court case. There's no shame in that; I've never done it and don't relish the prospect. If you use a no win no fee firm, they do it for you so you don't have to spend time and effort trying to get to grips with the law and process.


    I hope you are sucessful, however you chose to take it forward.
