  • Hi there,

Not too sure exactly how this thread works but just to let everyone know I have successfully claimed the money back on a flight from Manchester to Rhodes on 19/05/12 - flight number TCX2032 (was nearly 4 hours late). They sent me the voucher but have just spoken to them and they will be transferring the cash into my account instead. :-)

Edwolf88 - a 24 hour delay is not unprecedented - mine was 26 hours with Monarch and I am aware of delays considerably in excess of these. I took Monarch to court and the rest is history as they say. I suggest you give TC the same treatment - your flight was delayed over 3 hours you are entitled to the compensation.

hi thank you for the reply, when i said unprecedented i was not refering to the length of the delay but the reason for it. as i cannot find anyone who as tried to take on a airline with a simular case let alone won.

Edwolf88 - Apply the Wallentin test to the reason for your delay. Was it "not inherent in the operation of the airline and beyond its control"? It doesn't sound like it to me ...

thank you for the reply, but please what is a Wallentin test:question:

Go for the NWNF option, Mr. Wolf.

Check out the FAQs on page 1 of this thread before you ask any other readily answered questions. If you are going to take on this claim yourself you will need to do rather more reading up and understand the concepts involved rather than asking others questions such as this. Alternatively, if you are going to use a NWNF company then you won't need to understand the concept in any case since they will do the work for you.

hi, i understand there are people who dont try and do things for themselves, but thats not me. i have read FAQ on page 1, you may find reading and understanding the concepts of these answers, or the regulations. but i am having some difficulty and looking for as much help as i can. i like many others dont want to put my feet up and lose money by letting NWNF take over nor can i afford to take TC to court if i have not a snowballs chance. i have spent hour upon hours searching through information i dont realy understand, so no i am not lazy . i just want help from people who can.

You have to do the research yourself - if you do not feel able to then there are two alternatives - either walk away and forget it or go to a no win no fee.

I understand. But there is a limit to what help this forum can provide. Even if you were to find someone generous enough to help you construct your legal argument, and all the documents you need to accompany it, it is still you that needs to stand up in court - likely toe to toe with a professional barrister - and argue your case.

If after several hours reading of the FAQs and other posts you don't know what the Wallentin test is then - very genuinely - you need to think about getting some professional help. Because 70% of something is way better than 30% of nowt.
  • Thomas Cook Flight TCX 148 on Saturday 28th August 2010 from Antalya (Turkey) to Stanstead, delayed by 3hrs 2 minutes.

After numerous rejections from Thomas Cook, via the CAA, they have just acknowledged and paid out the compensation. They tried to pay in vouchers but when queried, they have converted this to cash - £339 per person.

    T Cook flight TCX6402 15/6/13 - Newcastle to Ibiza - 5 hour delay.
Has anyone any info or had any success with compensation for this flight? We claimed through correct channels first with T Cook then through CAA when original claim was rejected.CAA asked them to reconsider but claim subsequently rejected again.T Cook have not replied to several requests asking what was the exact nature of the technical fault which they claim occurred due to extraordinary circumstances beyond their control.
Any info will be very much appreciated!

    1) Read through thread - FAQ's page 1 important
    2) Realise CAA waste of time/space
    3) Decide on NWNF or DIY
    4) Be patient
