Hi
Can I ask which flight you were on please?

Success, kinda! Sent off template letter 28 days ago and today received a letter with a voucher for TC for £1391. Anyone had anything similar and should I reject and request cash payment? Thanks
Yes reject if you would rather have cash but make sure you copy everything and expect a Thomas Cook delay so they can hold onto your money a bit longer.0 -
I 'filed' a claim on-line back on 27th February this year for a delayed flight home from Cyprus on 13th July 2011, TCX1229, for my partner and myself. Didn't have any idea of the cause of the delay, just told on the way to the airport that we would be stuck there for six hours.
Had almost forgotten about it and only had the standard confirmation E-mail from them acknowledging the query on the day.
Saturday I got an E-Mail (same as already posted here many times) with attached voucher for £692 - couldn't beleive it :j.
Replied thanking them but asking for a cheque instead - of course!
I had also written to them (at the Godwin St, Bradford address) on the 1st of March about another flight delay, this time it was from Fuerteventura back on 21st November 2009, TCX56, which was cancelled and we didn't fly out until the next day. We sat on the airplane for a couple of hours before being told it couldn't be fixed that night and all shipped off to a hotel for the night - flightstats shows that there weren't any delays on this flight, don't know what's thats all about unless due to the original one being cancelled and rescheduled using the same name they are only reporting the new flight?
When I enquired about this with TC on the phone this week they had no record of the letter so took the details and logged it there and then - may be there'll be another piece of good news in a few months time?
1st claim took from 27th Feb to 4th May and was, apart from the time it took, completely painless so there's no excuse not to try. Still awaiting the cheque of course, but I'm sure it'll be coming through the door within the month.
If anyone was on the TCX1229 in July 2011 then you should have nothing to worry about. If anyone was on the TCX56 in November 2009 then get in touch and we can share responses?
Great forum, and of course THANKS Martin :T0 -
I have researched 241/2004 for 4.5 yrs and never seen this written in the regulation or any of the relevant case law.
Can anyone please point me in the right direction as our delay was due to its late arrival from its previous sector.
Case C-22/11 (Finnair Oyj v Timy Lassooy)examined “knock on delays” and ruled in Para 40 that:
“Articles 2(j) and4(3) of Regulation No 261/2004 must be interpreted as meaning that theoccurrence of ‘extraordinary circumstances’ resulting in an air carrierrescheduling flights after those circumstances arose cannot give grounds fordenying boarding on those later flights or for exempting that carrier from itsobligation, under Article 4(3) of that regulation, to compensate a passenger towhom it denies boarding on such a flight.”

Yes send voucher back and ask for cheque/cash and for correct amount as voucher tends to be less than your entitlement. It will take about 2 months but you will get cheque. I sent voucher back (£1260) and had cheque for £13800

I got quite excited about this a few months back, but "Vauban" post #1042 (ish) isn't so sure.
Yes. Because the issue being tested wasn't delay or cancellation but denied boarding (ie when the flight takes off but you are not allowed on). So in my view - though I'm no lawyer - I would cite it with care.0 -

TC claim to have 'lost' my voucher which was returned and signed for recorded delivery on 2.4.13. By quoting the Royal Mail tracking number they have conceeded receipt and on 2.5.13 promised a cheque but it will take up to another 28 days. Phoned again today 10.5.13 and it they say it was processed for payment on 7.5.13 but could take another 28 days from that date!
When returning Vouchers - send it recorded delivery and make sure you keep the tracking receipt. Then telephone to make sure they have it registered on the new system at Falkirk (tel 01274 387991 instead of the premium rate 0844 number!;))
Then keep pestering them to write the cheque. I feel sorry for the staff in the call centre but it's MY money.0
