received cheque this morning for £1500 from TC after declining voucher -this was just more than the 28 days quoted.

Sending my initial letter off today to the Falkirk office for the following incident..
Delayed by over 6 hours flying Orlando Sanford to Manchester on Thursday gone 2/5/12. Given a $12 food/drink voucher in total for the whole 6hour delay.
My issue is,
1 - Am I likely to succeed with a claim for compensation as the delay was due to the outbound flight to Cancun being diverted due to weather to Cozumel then the time it took to transport via land the passengers etc from the originating flight.
2 - Is $12 an entirely appropriate amount for food/drink for a 6+ hour delay? A meal and a drink at Sanford is around $15 for starters, and that's assuming one can go 6+ hours with only one meal!
I have recently successfully claimed from KLM for a cancelled flight so I have some experience of the process to go through.
Any advice would be greatly appreciated!0 -

You have received the bog standard template letter that most of us get from Thomas Cook so don't give up.
I am close to getting a response from the CAA , Thomas Cook wouldn't tell me what the Technical Fault was to warrant extraordinary circumstance but have informed the CAA ( I emailed CAA in Feb with my complaint) now I'm waiting on the CAA aviation experts to advise if my case warrants Reg 261/2004 !!0 -
TC claim to have 'lost' my voucher which was returned and signed for recorded delivery on 2.4.13. By quoting the Royal Mail tracking number they have conceeded receipt and on 2.5.13 promised a cheque but it will take up to another 28 days. Phoned again today 10.5.13 and it they say it was processed for payment on 7.5.13 but could take another 28 days from that date!
When returning Vouchers - send it recorded delivery and make sure you keep the tracking receipt. Then telephone to make sure they have it registered on the new system at Falkirk (tel 01274 387991 instead of the premium rate 0844 number!;))
Then keep pestering them to write the cheque. I feel sorry for the staff in the call centre but it's MY money.
:jGot the cheque this morning.:jThis was after at least 30 letters, emails and phone calls to TC and the CAA. They still don't say what the cause of the delay was on TCX2026 on 16.10.12 (Manchester to Paphos) but they have finally paid up. PM me if you were on this flight and I will let you have my TC reference so you can put a claim in. Thanks very much to all MSE users and advisers on this forum.:T0 -
I received the same initial response from Thomas Cook as Maz08, ie the rejection letter in January 2013. I persevered and also made a further complaint via the CAA. Two weeks ago a Thomas Cook representative telephoned me directly and apologised for the letter sent in January, and furthermore offered me compensation. I received a cheque for £2132 by post this morning for a flight delayed 22.5 hrs to Florida in 2008.:j0

Has anyone had any success claiming compensation for the flight from Gatwick to Paphos scheduled to leave at 0935h on 25th September, 2012 which eventually took off late afternoon/early evening? Have had two standard rejection letters from Thomas Cook ("planes are like cars") so am currently penning the CAA complaint template but would be nice to know if anyone else on the flight has claimed. Thanks.0

Just wanted to put a word a warning to all those who are following the advice to "just take them to court" This is in no way an easy thing to do and I would suggest using a firm to do your claim for you. I currently have my court date and am now attempting to put a court case together, in which I am expected to know all the cases to refer to, which I don't even understand when reading them, not having any legal training! I know of someone who lost their case without even getting to speak as obviously TC know what they are doing and have a full legal team. Also it has cost me £280 upto now and I'm not expecting to win as I'm not a barrister! Obviously I will let you know the outcome of my case after my day in court. I think this should be added to your FAQ page as had I known what it entails I wouldn't have attempted to do it myself.0

You're right that it's not super easy. It requires time (and some talent - though not legal training necessarily).
In your case, has the airline submitted any kind of defence yet? I recall they said they were "still investigating". It's not really reasonable to ask you to pull together a statement of claim if you don't know on what grounds the airline are refusing it. Have you any idea at all on what grounds they're resisting: extraordinary circumstances, 2 year time-bare, proof of flight?
There are people on here who will help you to prepare your case, including me. But you have to be able to at least understand the three key case law judgements (Wallentin, Sturgeon and Nelson/Tui), as well as the Regulation. There's also lots of good info on here about these. I suggest folk read those and, if it seems to much, go with a NWNF company.0
