    The only information I have per their correspondence is that “the delays were of a technical nature, which were extraordinary. This was prior to their still investigating defence. Can I pm you my witness statement and you can check through??

    For sure. I am currently preparing my own witness statement for a "technical defect is extraordinary" defence, so am happy to share that with you too. I will PN you my email address.

    Hold your nerve. It is up to the airline to prove ECs, and Wallentin - Hermann just about precludes an airline from using technical issues as a defence. Granted TC may have a rabbit hidden away that they will suddenly produce, but by failing to inform you of the reason (still investigating after how long ?) they are not behaving reasonably, and left you with no other option than to go to court. Also contradiction between what they originally told you, and "their still investigating defence", that's their credibility destroyed for openers. If you were them would you take that to court?

    Please can someone tell me what the uptodate address to write to Thomas Cook.

    I wrote to the address in Bradford but have not received any reply. It is now 2 months down the line and I am not sure whether to try a different address.

    Well no I wouldn't but they clearly would and are, as they know more about the law. They obviously knew their defence of " we can neither confirm nor deny" was acceptable to the court. On checking my papers this was sent on the same day they did the letter to me stating the delays were of a technical nature, which were extraordinary.

    Hi My Thomas Cook flight from Lanzarote to Belfast on the 28/09/2008 was delayed for 24hrs due to a fault with the aircraft. An engineer had to been flown from Manchester to fix the aircraft which eventually departed the next evening.Unfortunately I no longer have my boarding pass etc. Was anyone out there on this flight? Also Thomas Cook say they hold no information regarding myself and this flight . They have said they only hold information for 4 years and it is up to me to provide relevant paperwork. If this EU ruling entitles you to claim for delays up to six years ago then why do Airlines only have to keep data for 4 years, and trravel agents 3 years, or is this just another dirty tactic by Thomas Cook, etc.,Thanks

    Ninth Anniversary Combo Breaker
    After much correspondence to TC for a delayed flight to Mexico feb 2010, 6 hours, they have refused to provide me with the specific reason for the delay, citing it was extraordinary circumstances but no elaboration stating its a private matter to TC. Wrote to CAA in early feb no response, wrote again April, same default response. Wrote back to TC last week stating as they will not provide exact reason for delay no serving notice to which the ' office of directors' replied 'we await a solicitors letter'. Charmers.

    Still trying to find correct address to send claim to. Sent originally beginning last month but heard nothing, may have had wrong address. Can anyone tell me the address the claims should go to?

    Can anyone give me any info on NWNF Companies. I get the principal that they don't charge a fee unless they win but what sort of upfront Court costs etc should I expect to pay. Can anyone recommend a company? (I'm N Ireland based if that makes any difference). I do know I could and should take it to court myself but really don't have the time or confidence to do it!!

    Depending on the amount of your claim upfront costs are £80 for serving the papers (£2000 claim) £40 for further papers and £165 for court fees. I think NWNF companies take 30%,, just google and you will find a few. Hope this helps.
