Just returned home from holiday and have received, dated 2nd May, my court date of 5th June. I still do not know what TC's defence is. As it states Each party must deliver to every other party all documents which it intends to rely on, surely I should know this at the very least!!
Should I telephone TC as my attempt to settle this out of court and request details of their defence yet again? Or I could email them with all copies of my emails sent,, at least 40 although I have an email from them stating ' We have a full record of all your and our correspondence, you do not have to resend this in. so at leat I know I have done my part. I only have until 29th May to get all my papers into the court,, do I just need copies of all the emails back and forth?

Hi just wondering for some advice. We were delayed coming home from our honeymoon in Mexico over 24 hours. I send Thomas cook an email and this was the response
I am writing in response to your letter regarding your recent travel arrangements with Thomas Cook.
It is with regret that I note your flight with us was delayed. Whilst delays are an unfortunate part of air travel, I would like to assure you that a lot of work goes on behind the scenes to ensure that any disruption to our passengers is kept to an absolute minimum.
When a delay is initially identified, it is not always immediately apparent as to when a revised take off time can be secured. A number of factors have to be considered, which can vary dependent on the reason for the delay, and quite often we are reliant on outside influences, such as Airport Authorities or Air Traffic Control. Throughout, however, as soon as confirmed information is available, this is passed onto our customers as quickly as possible through our handling agents at the airport.
Although delays do occur on occasion, they can arise for a number of different reasons, and having carried out a full investigation the specific circumstances surrounding the delay to your own flight were of a technical nature, which were extraordinary, despite Thomas Cook taking all reasonable precautions necessary to prevent the situation. All aircraft can experience technical problems that are totally unforeseen, despite all reasonable attempts to ensure they are maintained to a good standard, in line with CAA regulations. This can be compared to any mechanical breakdown which can happen at any time without prior knowledge or warning.
I can see that passengers were provided with welfare during this time, which was deemed appropriate for the length of your delay. It is with regret to inform you that we will be unable to consider any claims for compensation as a result of the delay to your flight.
Please be assured that on-time performance is a key measure for us as a business, and we constantly review our operations to ensure we deliver the best results, and service. I would like to offer our apologies for any inconvenience you were caused on this occasion and I hope that despite this, your stay was found to be an enjoyable one.

Yes witness statement/claimant statement is 'your side of things'. Post any questions and someone will assist. You need to send copy to Court, one to the airline and retain the original for yourself.
Yes negotiate if you wish but ensure you keep a copy of everything as it may be needed if you do proceed to Court.0 -

just received letter with voucher for £692 for delay from glasgow to dalaman back in 2009, have just phoned to get a cheque sent instead though!
sent off 1 template from here in march really didnt think it would be so easy so many thanks to all on this forum couldnt have managed without all the advise!0 -

i have just heard back from Thomas Cook about a flight delay we had at Gatwick on route to Goa that was delayed for 26 hours only to be told by them to take it through the small claims court. Has any one had the same and what next please0 -
My next step is going to court, but my only worry is that as thomas cook refuse to tell me the problem with the plane apart from technical problem. that when they come to court they give a the courts something that is valid under EC is this the risk I have to take. Or will the court take into account that TC have refused this information to me telling me this is a private matter0

Hi new to this so not sure if doing this correct my self and family were delayed 4:45 from dalaman to Manchester August last year I have sent claim to thomascook they have replied with a holiday voucher for £1260 I have emailed them back and said thanks but no I want the correct amount (£1500 aprox) in cheque not voucher how long do they have to respond and have I done the right thing
Got cheque today £1380 so don't give up keep fighting you will win good luck to everyone:D:D

Basically I sent a letter back in mid February and got an email reply telling me the flight was delay due to technical issues, thus extraordinary circumstance (obv we all know that Bull!) Anyway I was very busy have have only got back into writing things up in prep to contact the CAA - I will send the letter to the CAA via post however, as I got an email response from Thomas Cook, I thought it would be easier to reply with my 14 days notice before legal action letter via email.
However I haven't heard from them. I sent it on Monday and I know it will take time but I just want to be sure that they won't kick because I didn't send then a letter in the post.
Also does anyone have any tips for the stage I'm at the get maximum results?
Any help would mean a lot! Thanks0
