Yes - the lawyer was clear that incidents on previous flights could not count as ECs.
And actually he didn't talk about windscreens or cracks at all - but a birdstrike which would force the airplane immediately to land.
The CAA guy though was hopeless. Who could be confident that they had passengers interests at heart? Not me, for one.

Can anyone give me the Falkirk address? I have been receiving correspondence from TC but not surprisingly they don't actually state which address its coming from. The only address on the back is the Registered Office in Peterborough. I've been sending previous letters to Bradford and cc'ing to Peterborough to be doubly sure!!
No they don't have any address on the letters from Falkirk; this is on the frank on envelope that the letters arrive in;

Are Thomas Cook actually replying to their compensation
Claim letters, we had 4.5 hr delay from LBA to
Menorca and it has been 4 weeks since I sent
off my claim.
I sent my claim to Thomas Cook PLC
6th Floor South, Brettenham House, Lancaster Place, London.
I put a return address on env if not delivered.
Is this the correct address .0 -
I have finally received my cheque from TC, even in defeat they dragged their feet. To all those waiting and waiting for TC to get back to them, make sure you stick to strict timetables with them and don't expect common sense, the only way they listen is when they're faced with court action.
If your claim is worth fighting, take it all the way, don't drag your feet.

Thomas Cook has pushed mine to the line and submitted a defence with the same old blurb “extraordinary circumstances” due to a “technical fault” but they do not tell the courts in their defence what the technical fault was and have not responded to my written request either. My claim is now at the final stage so I won’t say too much at this point as I may be standing in a court in a few weeks as it has been referred to the county court due to the high value.
However, the court has advised in the papers that I should request a one month deferment to try and settle out of court which I have done. I am prepared however to go all the way and I have even sent the next fee and Directions Questionnaire to the courts copying to Thomas Cook this morning, registered and tracked with next day delivery, but now I have one last attempt to settle with Thomas Cook before the journey to court.
The only thing I am waiting on for over three months is the report from the CAA even though I have e-mailed to push them twice. They suggested last night on Watchdog that people should use them rather than go to court as they are free but they need to speed things up a little first and at the end of the day they have no enforcement powers.
Anyone also notice on Watchdog that the EU has issued new clarification to airlines on what is truly EC which wasn’t much, I think it was weather and control tower issues are going to be the main two but it can’t be used for “Technical Issues”.
One question that someone may be able to advise me on, I have sent the forms, as advised on the court papers to Thomas Cook Legal dept at:
