    Thanks for all the posts and advice Martin, much appreciated. Started the claim November, rather than use the courts i used the Financial Ombudsman and have recieved a letter yesterday saying the bank have agreed to pay.

    Thanks so should I send a LBA or go straight to the court form as I have been told Ulster Bank will only settle when they recieve the court papers and they make you sign a confidentiality agreement.

  • Hi guys, Matti's here.
    I follow the procedure of getting back the penalties and so far I sent them letter with the request for the list and I spoke to they guy on the phone right now,cos it's been already over 40 days.Now he tells me that the only way to get the list is to pay £2.50 for each duplicate.
    Does anyone know if this is wright? Should I sent a complaint to Information Commissioner?

    mmcourt, if I was you i would try the Financial Ombudsman, as you have seen it works, think i will go that way if i ever got my default charges of them :mad:

    They can charge you £2.50 per copy statement if you request them but you are entitled under the Data Protection Act to receive the details for a £10 fee which you have already paid (or not if they dont charge it). I would send complaint to the Information Commissioner at the breach of this entitlement given that 40 days have passed. That you have not received your data and were told you would have to pay extra if you wanted it.

    I would ring back and tell them you are entitled to the details within 40 days and if copy statements is the only way you can get this information in that time then they are responsible for the delay, not you, and any extra cost is their responsibility. Advise them that official complaint will be made to the comissioner.

    I asked a Q earlier in the week but appreciate that there are so many on here to answer!

    I have won by Default on 24th April, just wondering how long I should give Lloyds to pay my monies before sending in the bailiffs?

    A few other people have asked this question before, so any answer would be fantastic!

    Your previous two posts asked if anyone waited long for their monies and so I didnt answer because I havent experience to share on this particular point.

    To now answer how long you should give depends on how soon they or you get written notification of the judgement. On your receipt of this I would go into the local branch and ask to see the manager and give it to him to resolve. Make it his problem and I should think a phonecall to Head Office should resolve the matter quickly enough. Regardless of whether you do this I think 7 - 10 days is plenty of time for them to receive judgement and act on it.

    I dont think calling in bailiffs is a neccessary step until you have at least approached the bank directly and you may save the extra fee and the extra time this solution will take. Good luck getting your money soon :)

    I think I will call LLOYDS H/O tomorrow, or today if they're still open, and I'll let you know the outcome.

    I sent letter 1 from the templates to the halifax requesting 6 years statments on 03/03/07 on the 18/03/07 they cashed the cheque, goody i thought things are moving alone quicker tha expected, However 23/04/07 still no statments phoned the bank who denied having recieve the letter(this was recorded mail and signed for by the bank), I pointed out they had signed for the letter and they still denied getting it I then played my trump card :D
    me:
    "but you cashed the cheque and the letter was in the same envolope"

    bank clerk :
    " oh erm let me check.........erm well, yes the cheque was cashed ..... erm.....no request has been placed on the account for this information, i'll place a request now"

    me:
    "can i expect the statments next week then?"

    bank clerk:
    " no it will take another 40 days from today"
    after reading her the riot act i advised her i would not wait another 40 days and told her i would be sending another letter to the bank demanding this info in 7 days and a copy of the letters to the information commisioner.
    has anyone else had this problem with halifax or any other bank

    It's fine, I tend to think in straight lines and since I couldnt answer the question I didnt, thats all :)

    Ring MCOL first and find out when the bank should be receiving notification of judgement. I dont know if they will even know about it yet and it might save being put on hold with Lloyds and being passed around costing you a nasty phone bill.
