  • Please can anyone supply me with the main contact address for hsbc.Day 40 has just started and I fear that hsbc has no inclination of replaying so small claims will follow within the next 7 days

    I am from Scotland and I am claiming against Bank of Scotland I have got as far as sending the second letter and got a reply back telling me that I have to give them 4 weeks to deal with my complaint I now need to send the third letter but the sample letter says county court name but we don't have county courts in Scotland what do I put in it place?

    Or should I give them the 4 weeks to see what they come back with?

    Hi, read through any of the links in my signature for guides. The video of martin is very nice and clear. Not sure about the Scotland county court issue, but I have glanced across other people talking about their b.of Scotland claim, hence no idea which thread forum it is off hand!

    As for waiting four weeks. Martin mse, emphasises to stick to your time scale (also in the links in signature below). Also some people seem to be phoning up as well which might help if worried, but keep to time scale and send letters recorded delivery too etc.

    There is a certain 'Edinburghlass' I've come across on this forum who may be able to help you I suspect! Her name is amongst the links in my signature and has helped a lot of people, so I'd expect she'd be able to help you!

    Question barclays 40 days!!!!!!
    Hi there,i sent of my first letter on the 20th march,i had a letter from barclays saying we will be sending your statements in the next few weeks,with out charge!
    i have still had nothing from them:mad ,what should i do know????
    i am really worried i may miss the boat!!

    I know that someone rang their bank 3 weeks after requesting their statements, and they were really helpful on the phone so that helped. I'd say go to the Barclays thread for extra help, ..click on 'discussion per bank' in my signature to get the barclays thread link. The emphasis is on sticking to your timescale, but without your statements that bit is a bit trickier without those details. So I would suspect you need to hound them and keep hold of your recorded delivery slip. But check out the barclays thread too maybe.

    Someone I've got into this claim thing is about to have the same problem in just a few days, as the first 40 days will be up! ..which is with halifax bank.

    EDIT: I've just been fishing around before turning of the pc and found this very useful post from a 'troubled student' who is being ignored by their bank with regards getting statements... click HERE the advise there is about the next step..and gives a link. So hopefully thats what to do!! hope this helps. But I think its would help if you ring them first incase that saves you time and effort filling in the form to the Information Commissioners Office which is the next step if you don't get any joy out of them!

    please someone help:

    Another person I know unfortunately sent their £10 cheque and letter to request statements to the wrong 'local bank'! (Barclays). As they forgot which town they first joined with, but sent it to the bank/town they now live in. Although , maybe this is ok I guess? I think I'm panicking because they are!! They didn't send it to the main registered bank, can anyone reasure/tell me if they should send all the letters to the registered banks, or local bank? or both? (although I doubt its both as this would involve 2x £20 cheques?). Any help greatly appreciated. x

    I'm thinking about trying to reclaim, however... I thnk most (possibly all but afew quids worth!) of my charges were over six years ago when I was a student and also I had a lot on an old now defunct Natwest Credit Card which I no longer have details of.

    Is it worth me bothering for a couple of quid from my Natwest account which I am happy with?

    This, I think, is a serious problem and I would really like some advice from anyone who has some legal know-how.

    I claimed £1384 from Nationwide on behalf of my son and made a claim on MCOL. The day before their 28 days was up I received a letter from Nationwide stating that they were refunding MY charges to me and had paid £155 into my account! I checked and they had and there was £184.48 to follow to cover costs and interest. They had even enclosed a charges summary headed with my account number. All of this was very nice for me, but had nothing to do with my son's claim, and the bizarre thing was that I had not made a claim for charges!

    They will have looked at the name on the letter and matched it to your account number, for some obscure reason. If your sons account number was clearly stated this is an error, obviously.

    I rang Nationwide and explained the situation and thanked them for my charges. Now it turns out that, having taken advice from their legal team, they are about to take away the £340.48 they have given me (on the grounds that I did not claim the charges, even though the money is mine).

    They are entitled to do this. It would have been nice to be able to keep the money but it was paid in error and is repayable. You dont state whether the charges were from your own account or your sons list. If they were from your own account then go ahead and reclaim then officially.

    They are going to look at my son's claim. Today I received court papers headed "Notice of Defence that Amount Claimed Has Been Paid" In it they claim that they have refunded all charges debited to the Claimant's account..... The finish by saying"No further sums are due from the Defendant to the Claimant". This has been signed by their In-house Solicitor. Seems to me that they could be in serious trouble for this....does anyone have any ideas please?

    Check your sons bank account, as you do not say if you have done this, to make sure they havent actually paid him too. If they not actually paid your son the full amount & interest & costs then the claim still stands. If they have made a part-payment then he needs to write (not phone, a letter is evidence) and my advice is to reject it at this stage. He is entitled to the full amount & interest & costs and accepting part-payment at this late stage will only complicate matters further in my opinion. Better to reject it completely and you are under no obligation to accept it anyway.

    From a legal standpoint the errors on his account do not jeapordise his claim and it is still valid unless they have sneaked the full amount he is due into his account including interest & costs.

    You can advise the court that they paid money into your account in error but it will not have any legal bearing on his case as to whether he is entitled to the amount he is claiming or whether he succeeds. The judge will see the banks for the idiots that they are but the claim is validated on the point Consumer Law it is claimed under and I am afraid that that is all that will be strictly relevant.

    I am sure the Financial Ombudsman will be interested in the fiasco though and would certainly make complaint to them regarding all the issues raised. I would make further complaint to the Information Commissioner regarding the breach of Data Protection in accessing your account regarding your sons claim. It's easy to see how they got confused but they arent supposed to get confused.....

    You can claim back further than six years but this is reliant on you having all the details from that far back and not every bank or institution will have those details if you need to request them.

    Yes its worth bothering to reclaim a couple of quid. If the charge is unlawful it should be reclaimed on principle, but thats just my opinion. :)

    Thanks very much for the reply. I will certainly do what you have said.
    The charges they refunded were from my account and dating back to 2001, but strangely, they were made up not only of the usual £20/£30 charges for mis-use of card etc, but also those little monthly interest charges that I had thought they would not refund.
    We have been checking my son's account all the way, but there have been no deposits. In fact, because they withdrew his overdraft facility recently he has now incurred a further £90 in charges since we started the claim.
    Thanks for the advice and I will let you know how this proceeds.

    I sent my letter this moring to First direct who actually are a really good bank customer service is always spot on, iv listed excess and over draft charges as when i go over my over draf thet charge me and over draft fee and a excess fee BUT when i dont go over drawn ( not very often!) they dont charge me anything??? so would the over draft fee count as it only gets charged when i go over
    Iv noticed a few first direct posts asking this?? Thanx inadvance x

    You can claim for any Unauthorised Overdraft Fee. This will only be charged when you go over your overdraft limit. You cannot claim for Overdraft Interest Charges.

    Can anyone advise me on the following?

    I sent off to Natwest for all charges on all my accounts including my credit card account. I have since been told that I will have to pay another £10 to get my credit card statements as Natwest card services is a seperate part from that of Natwest Bank PLC.
    Is this the case? or does the DPA cover Natwest as a whole or each individual department within Natwest PLC?
    Natwest - LBA sent 26/04/07, FO. Sent email to Michael Duncan on 11/05/07. SUCCESS - Offer letter received 19/05/07 for full amount.
    Natwest Credit Card - 1st letter sent 27/4/2007 (£294) SUCCESS - Full amount repaid
    Capital One - 1st Letter 03/2007, FO in Sep 07. SUCCESS full amount repaid Jan 08
