    Hi Twinkly

Thanks very much for the reply. I will certainly do what you have said.
The charges they refunded were from my account and dating back to 2001, but strangely, they were made up not only of the usual £20/£30 charges for mis-use of card etc, but also those little monthly interest charges that I had thought they would not refund.
We have been checking my son's account all the way, but there have been no deposits. In fact, because they withdrew his overdraft facility recently he has now incurred a further £90 in charges since we started the claim.
Thanks for the advice and I will let you know how this proceeds.

    Hi Hilary
You're welcome and thank you :) I just wanted to add something about your own account in that case then. It would be worth your while writing and advising them that since you intend to make claim on your account, and that they have paid an amount into your account in respect of your own charges, that it would save time if they simply left it there. That you will accept the amount as partial settlement without prejudice of your pending claim for charges applied to your own account during the last six years.

They may refuse of course but it is worth a try and since you will get your money eventually you have nothing to lose by asking at this point and a few hundred quid to gain. Good luck :)

Sweepy - To the best of my knowledge, NOT ONE SINGLE BANK has ever actually gone to court to defend a claim to date (though that's not to say that one won't take the plunge sometime). There are numerous posts on the success forum that show most banks cave in a day or two before the deadline. In my opinion, it's just a tactic they use to try to intimidate you into withdrawing your claim. There are lots of posts about Abbey on the success thread. It seems that Abbey are one of the more obstinate ones, yet everyone seems to beat them when push comes to shove. Just sit tight. I've also got a 'defence' statement from my lot (First Direct). I just say 'bring it on'. I'm sitting tight and waiting for them to make me an offer (which I am confident they will).

Thanks for that the amount for me is £4131 so its quite alot. I have changed my accounts over so all that is sorted i need the money for a new roof lol.
    thanks again

  • hi, i have just put in my 3rd letter to natwest asking they repay my charges and interest or i will take it to court, as it is above £5000, which court will i have to apply to, and how, as £5000 and below is small claims court, natwest do not appear to be playing ball as i never received an answer to my 2nd letter,

Well done! I'm in exactly the same situation with Prat West, I sent the 'Don't intimidate me' letter to Cobbetts on Monday (& a copy to the court).
How long did it take for you to get the cheque after you sent your 'don't intimidate me' letter? I've been mentally preparing to go to court:eek: , but maybe there's hope for me yet!

Thanks Twinkly. I will try that. I have checked my account today and they have not, as yet, taken the money out, so maybe they are for once using common sense, and witing to see if I claim. I did indicate to them yesterday that that was my plan. Do you know how far back you can claim? I thought that it was just six years but I think I read in one of your messages that it is possible to claim back further.

    Will keep you posted.

i am new to this, please excuse if I havn't done this correctly, but do need some advice.

I have issued summons against the Abbey which they are defending, I asked for a breakdown of their charges and costs and they have replied with a letter stating
" We note the quantum of your claim " not exceeding £1500.00 " and In view of the same Abbey National PLc is not required to provide you with the information requested. We refer you to the civil procedure rules in this regard, ..........Is there anything I can do in this because this is the essence of my case, the bank charges that they apply for the work involved

    please help
    Thank you
