  • I am claiming £2162.50 from HSBC, the time has come to fill in my claim form, what address should I put for the bank, a head office one or my branch address? I sent the original letters to my branch.
    Also, can you claim interest on the claim form even if you didn't work out the interest for your original letters to the bank?

    You only need to do this if you intend to refer the matter to the Financial Ombudsman as you are required to exhaust the banks complaints procedure before doing so.

    As you are following the process laid out in the main article the timescales in the templates are sufficient to show the court that you have given the banks ample oppertunity to settle your claim before court action. You've allowed more than enough time since your first letter so you can now send the LBA (letter before action). Good luck :)

    Hi
    I sent my first letter to LloydsTSB last friday, reclaiming almost £5000 in charges! (nearly fell off my perch when I added it all up!) I decided to put in that letter that I would take them to court if I didn't received a satisfactory reply with in 2 weeks. Today I've had a letter saying that they are sorry I'm unhappy and they are waiting for replies to some of thier follow up enquiries (what enquires - they took my money!) and they will respond fully within 4 weeks. Can I now proceed to court action as I've not had a satisfactory response? I sent the letter to my local branch, the reply is from Birmingha so what address do I put on any court papers?????

    The recommended course of action is two letters, one asking for your charges and the second gives the bank 14 days notice that you will be taking them to court.

    Please read the Reclaim Help Thread, link in my signature, for addresses that should be used and lots of helpful information regarding court fees etc.

    As regards waiting 4/8 weeks for a reply from the bank you should follow your own timescale of 14 days from the bank receiving your letter and send out your next letter on day 15.

    I suggest local branch .If you have to go as far as warrant of execution
    it is in your interest that your branch receives bailiffs, far easier than head office. Good luck

    Has anyone having success claiming from RBOS done so claiming with or without interest, really unsure which way to go.
