I have had one successful reclaim already and am persuing another seven:cool: .
Is anyone able to answer this question??
If a debt from one of my accounts has been passed to a third party which will have included the charges etc, do the actually have any rights to collect the debt? If you see what I mean, eg I am reclaiming bank charges from the Bank of Scotland. A debt recovery company is now collecting the outstanding monies, this will obviously also include charges levied on the account by BoS. Am I allowed to say to them that whilst I am persuing BoS for charges they put the debt on hold?????
I would welcome your thoughts. It would be quite satisfying if I could....:D

I would just like to point out that I received a letter from Capital One this week stating that they enclosed all mys statements free of charge. Also Natwest and Royal Bank of Scotland informed the charge was only £5.00 each regardless of how many accounts at each bank. I did not send the £10 with the original letter, instead I added a sentence at the bottom stating that if a charge was applicable, I would appreciate a letter informingme of this by retun. Both banks sent the letter within a week. Now the game begins.........................0

You can ask but it is up to the DCA if they do this or not. Be aware that any monies reclaimed may well go towards the debt.0 -
Can anyone tell me what the position would be. I had a RBS Business Account which closed with an overdraft. They took me to court and obtained a charge for the amount. I have just applied to RBS for my list of charges. What I would like to know is - Am I still eligible to put a full claim in for all the charges? If I was awarded charges then could this then be used to reduce the outstanding amount they are claiming from me?0

Hi there, I am new to posting but have been reading it for a long time and started a claim from Alliance and Leicester about 6 weeks ago now.
I had conversations just like Discarnet almost word for word(posting earlier )when i first asked for my charges etc..they denied receiving my letter or my £10 but after i gave them the code for the registered delivery and the date they cashed my cheque they changed their tune...to get this far, I had about 6 calls to different individuals, all very unsatisfactory. Got the charges, sent off the claim and a week ago i received a letter saying pretty well"sorry you are unhappy, but only credit card charges are being refunded...blah blah" Now sent off the next letter giving them a further 2 weeks to come up with the money before i take them to court.
Question: has anyone had recent dealings with A&L? They seem to be taking quite a heavy line...quite scary really! Do they carry through the threats of taking it to court??? I have set up parachute account so am quite happy if they want to close the account AFTER I get the money..
