Can anyone tell me if i can claim a 'referral' charge?

My only problem being the letter which she did receive stated if they don't her from her by 15/05/07 they will close her file
What do I do next??????????????????????????????????

Dont worry about them closing her file it just means they will consider the 'complaint' closed. They are required to follow timescales laid down by the FSA and this is only relevant if you are intending to use the Financial Ombudsman to reclaim. It is because you must have exhausted the banks complaints procedure before referring it to them.
You are following a court process reclaiming by following templates and timescales laid out in the letters. These are to show you have given the bank ample oppertunity to settle the dispute before bringing it before a court.
With regard to the timescale for receiving your details. They have 40 days in which to provide them and this is the only timescale you (and they) need worry about for the moment. They can close the 'complaint' for now but there is nothing at all to stop it being reopened when you have the details. You can make as many complaints as you like and they have to deal with them, its as simple as that really. Good luck0 -
Hi i have filed my claim with moneyclaim which was then transfered back to my local county who have now transfered my claim to London Mercantile Court.
Does anyone know what this means.
My claim is against First Direct.

Got my letter from the Ulster Bank this morning. It reads
" Thank You.......etc, we believe that our charges are fair, reasonable and transparent. We consider that the amounts debited to your account have been applied strictly in accordance with your agreement with us and our published tariff, which we are satisfied, complies with all applicable laws and regulations.......,consequently we must differ with the views expressed in your letter and I, therefore regret to advise you that we will not be refunding any of the charges applied to your account......., we have enclosed a leaflet incase you want to take the matter further".
Its an ombudsman leaflet. Do I send the second letter now or just apply to court. Please any help would be great???Winnings 2009: Rimmel Pro Lycra Nail Polish.

anyone know how to claim in scotland. the only difference i could find is thats it5 instead of 6 years you can claim back. could i use the template letters on this site ?

Me again with another situation!!!
Done everything right with the templates etc(Lloyds TSB), usual responses .Ready to file mcol now for my partners business account. But something strange has happened!!! My partner ,stupidly i know ,Let this business account just drift on with him 2000 overdrawn (mostly charges) and had no contact with the bank for three years or so. Yesterday i made him ring the bank to see what state the account was in now. When he rang, they said they had closed the account in 2005!! What about the overdraft?? Dare i still claim the charges back or should i let it go?? any help please? thanks xx
Thankyou Edinburghlass and twinkly for taking the time to answer. I`m stiil a little confused though. When my partner rang the bank to find out his balance, there was no mention at all of the outstanding overdraft and although they have all our contact details, they have never written to him. If i claimed the moneyback could they enter in there defence that they had closed the account and overdraft(which would be great). I just don`t want to lose the court fee. Perhaps this would explain the mysterious check that arrived a few months ago for £50 as an overpayment of bank charges? Any thoughts anyone? Thankyou x0 -

Thanks for all the posts and advice Martin, much appreciated. Started the claim November, rather than use the courts i used the Financial Ombudsman and have recieved a letter yesterday saying the bank have agreed to pay.

Need help.
Have asked for 6 yrs statements. Barclays have fannied around for almost 40 days (Saturday is last day). Have been told on various occasions they've been sent and they're awaiting posting???
Has anyone else experienced this at all? What advice for the next step if they don't send within 40 days? I have read what to do but just wondered if there was anyone who's experienced similar resistence to me.
Any help would be greatly appreciated.

They cant reinstate an overdraft thats already been refunded in that case and that would be the first I've heard of a bank voluntarily refunding charges, thats a bonus for you :rolleyes:
I dont think you have anything to worry about and if you have checked all the details and still find you are owed monies then they didnt refund them all and you are entitled to them. Good luck0
