Hi mmcourt, have you asked for your list of charges on the 16th April from the Ulster Bank or did you already have them? I now have my letter of complaint made out for the Information Commissioners Office about the Ulster Bank Ltd, I will post it on Monday 30th April.

Hi Ya I already had my charges, im a bit of a hoarder and had all my statements. Considering ringing them, dont know what to do !!

Abbey seem to be taking their time to provide me all the requested information. The 40 days was up so wrote to them last week complaining that the information had not been sent to me and requesting that they send it to me as a matter of urgency. On Monday this week got a letter back apologising for the delay in sending the information, they have refunded my £10 due to the length of delay. I now have info going back to 2004, they have said they will send the info prior to 2004 as soon as they can. They are getting until Monday then I am complaining again! Suppose at least I got my £10 back!

Be careful. I have a friend with Abbey and they took a long time to send he anything then when they finally did they had removed some of the charges. So she paid to have duplicate statements sent and sure enough they did not match the ones she had.
    Regards

Yesterday i made him ring the bank to see what state the account was in now. When he rang, they said they had closed the account in 2005!! What about the overdraft?? Dare i still claim the charges back or should i let it go?? any help please? thanks xx

    Afternoon Everyone!!

I know this question has probably been asked a hundred times or more but i cant seem to locate a thread to reference against!!

could anyone please advise me the best step to take next in regards to my claim against the ALLIANCE & LEICESTER?

I have got as far as the MCOL stage and have taken them to court (proceedings started on Friday 20th April) but today i have received a cheque for roughly half of my claim, which obviously i do not intend on accepting but ive heard & read that i can accept this as part payment and proceed with claiming the remaining balance!!

does anyone know how exactly the best way of going about this would be as i would like to bank this cheque (as it would come in really handy at the moment) and carry on with my claim.

i really just need to know the best way of going about this please!!

    your all stars!!!

    thanks

But... any monies reclaimed are likely to be refunded to the overdrawn account.

Write something like this to the bank:
"I cannot accept your offer of £xxx as full and final settlement of my claim. I will accept this as part payment and without prejudice, but will continue my claim for the balance. I have made a reasonable effort to settle this claim before issuing a court claim, but you ignored my efforts to settle this. Seeing as I have now had to issue a court claim because of your failure to deal with my claim in a timely way, I will now settle only for the full amount of charges + statutory interest + court fee."

You also need to inform the court that part of the claim has been paid, and amend the amount you are now claiming for.
