Help please, Im very stressed as I have some debt issues Im sorting and Lloyds now have said I cant claim my bank charges of over £660 covering up to the last 6 years. Lloyds say that the guidelines relate to default charges and they dont apply to me beacause I havnt broken an agreement and I quote "they are our prices for the service we provide..."
In short I have an OD of £50.00 set up I also took out a lLloyds Loan which I paid £330 per month by DD from my Current Account with Lloyds, however being self employed i soon had money problems and couldnt make the payments, In October I was OD about £17.00 but they went ahead and serviced the loan payment when I asked them not to. This made me OD £347. To date I now owe them nearly £600 as they charged me about £70 a month. I have followed all the advice about recaliming charges and even complained to the FOS about the way Lloyds are dealing with me.
Conclusion, FOS say it will be up to 9 months to sort and Lloyds say I cant have my charges. QUESTION, am I or am I not entilted to claim for the bank charges and if so my next step is the court, can or do I have a case or will I have to wait for the ruling of the FOS which may be 9 months time. Many thanks for anyones help on this as I am becoming very depressed and fed up trying to cope with all these problems. I am sure I am not alone.

Is your complaint with the FO regarding your bank charges, as they will take this on, or regarding the treatment from the bank?
If the FO are handling your bank charges claim you need to leave it with them now but if not you can now start your court action against the bank.0 -
I think LTSB are starting by playing the long game with me, I have now had two letters off them first on 21 March (20 days after my first letter asking for details of charges and £10 cheque) stating they may need 4 weeks to reply.
Yesterday received a letter (dated 10/04/07) stating that it will take a further 4 weeks to,
"write to me with an estimate of when I can expect a response"
and
"thanking you for your continued patience"
has anyone else had this yet?
I have tried ringing the Customer service number but it always seems to be engaged... off the hook perhaps?
So this morning e-mailed the Information Comisioner asking for advice.
Can anyone here shed any light in what seems an even longer dark tunnel?0 -
Hi All,
I have at last recieved the list of Charges that I have incurred from LLoyds over the last 6 Years.
On my Initial first letter I did not request interest, Can I do that on my next letter that i send to them demanding my Money back or should I have done this on the first letter?
Any help greatly appreciated

I'm claiming £4,200 plus interest from the Yorkshire Bank. I started court action last week and they have now sent a letter saying that I've not supplied enough information and requested that I go through all the bank statements and inform them of which charges I am claiming for and must have a reply to them before today!!!!!
Does anyone know if I should reply to this letter as I've started court proceedings or do I just ignore it. I can easily send this information but I don't want to if I don't have to????
Someone please reply as I'm getting really worried about what they will do if I don't reply.

Like any business we do make a charge for some of our xtra services. When customers don't have enough in their acc's to cover a payment, this always means extra work, and has to happen quickly. The OFT has published new guidelines on credit card default charges ???(very odd I never asked about these?)We're still talking it through with them, but the important point is that the guidelines are about "default" charges that people pay when they break an agreement with us. This does not apply to your Charges as these were for dealing with your request to go over your agreed overdraft limit. Theny are not default charges because you have not broken your agreement. They are our prices for the service we provide in these situations.
I understand that you may also have some concerns about us sharing your information with credit reference agencies we use, I'd like to re-assure you that this does not apply to bank charges, only white data payments to credit card, loan or mortgage acs.
I do hope that you can see that we make our charging as fair as possible and why I cannot agree to cancel your charges.
