Claiming in a DMP/IVA (merged)

Just starting a DMP and will be finishing with Lloyds TSB ( Good Riddance !)
Can I reclaim still or not..also HSBC loan is being taken in on the DMP and we were with them prior to Lloyds. As they are both implicated by the DMP can I still reclaim..Please say "YES" !!

  • Hi - I am in a similair position, I am going to give it a go, i am hoping that they may refund some charges even if they credit it to the defaulted account which will reduce my overall debt with them. Thing is then, im not sure how this will effect the DMP, because I am only paying a percentage back anyway. Tricky one...

    You can claim in a DMP. However I'd speak to your DMP provider first to get the full info. A DMP is not legally binding and it could be possible for a creditor to pull out of the agreement if you pìss them off by trying to reclaim charges.

    Hiya i have checked with my dmp and they have said it is fine for me to go ahead, i am will natwest and they are also my biggest creditor on my dmp.

    I would check what your dmp company say, but mine told me if they bank do pay up my charges, it will more than likely not be delt with by the same dept at the bank that deal with dmp.
    And that if they pay up they have admitted that the charges were unlawful, so wouldnt be able to use this against me or the dmp.
    As all i am trying to do is reduce my debts by any means possible, if this means claiming back unfair charges then so be it.

    I would check what your dmp company say though, but i for one am going to give it a go.

    dlb - thanks for that reply too. I could see no reason why we shouldn't be able to claim. Unfair means unfair afterall !
    I am with Payplan..is that who you are with ?
    I have done the letters at the weeken and have them ready to send.
    haven't done HSBC yet as they were my previous bankers and they have about 16k of my debt. Unsure if I should rock the boat. But Lloyds I will deal with as the debt isn't so bad and we had been to them in September to say that we were having difficulties so heres fingers crossed.

    Hiya bluediamond i am not with payplan at the minute, but intend to change over to them after xmas, i am with a dmp that take money off me for the service, i joined them before i descovered this fantastic site and didnt know that free dmp where available.
    I am only waiting until after xmas as that is when my rent arrears will be paid off through them and i didnt want to rock the boat buy changing over before then.
    Good luck ref bank charges and let me know how you get on.The bank i am claiming of is also my biggest debt 14k but im going for it anyway.

  • At the momment I have DMP on going, but I do know that I have paid a lot of bank charges in the past. Does anyone know if I could claim the bank charges? I would of course pay the money back to the banks in question if I was succesful, and it would lower the amount I owe them!

    im in a dmp and reclaimed from halifax and it put me in credit so one less creditor i need to worry about lol
  • Hi, I started on a DMP in October this year and so far have made 2 payments to CCCs. (£357pcm)

    I started out owing £23,000 or thereabouts but this has increased to £27,000 re charges from my bank!

    I have a feeling they're doing this as they're about to sell the debt on to a debt collector of some sort.

    My question is this..........can I claim back those charges if the debt has been sold? Even if they haven't sold it how do I get them back? All £3000 worth!!!!!

    If your dmp has been in touch with the bank im not sure they are allowed to sell the debt on, i maybe wrong but someone else will be along soon who will know.
    I too have been on a dmp since feb and it did take about 12 weeks for the bank to stop charges, your dmp should be in negociations with the bank at this stage ( 2 months in to dmp), i would phone your dm company and ask what is happening ref the bank account.
