cheers, i only ask cos im in the middle of an IVA application at the moment with LTSB being the biggest creditors including my bank account/overdraft. wil they get the hump if i now go ahead with a claim against them and will it hinder my application at the meeting of creditors?0

I have posted before but for those who don't remember...my partner and I are reclaiming from our previous banks.
We are on a DMP at the moment with the CCCS which is only one month in but already we're feeling the weight being lifted.
We're hoping that any reclaimed charges will be used to help me start my business, and to do home improvements that are very much needed (there are things about to fall down if these aren't done soon!)
I'm very concerned that the CCCS will not let us, and will demand all of the reclaimed money.
Does anyone know how they would view the money?

My accounts are in a bad way. My TSB its on a pay plan till the march payment then it will go back to normal in april. My egg account is with debt collectors called capquest.
What are the chances of my claiming any money? I actually paid of a 150 quid overdraft with TSB and then I will be closing that shortly.0 -
It's quite a long story, but my husband lost his job January of last year - the HSBC were appalling and offered very little help in our situation, they continued to charge us huge amounts every month. We have been with them for 12 years and last May they froze our account as we were attempting an IVA. We also have our mortgage with them. We bank with Nationwide now and still owe the HSBC roughly £3,000. We are in a DMP and they are receiving monthly amounts. So my question is, with our account frozen and not active, can we still reclaim ? Thank you.0

Hi this is my first post on here and I just want to check I have this right before trying to claim.
Having read through this, I am currently in an IVA and part of the reason I was in trouble was because HALIFAX kept charging me for bring overdrawn and sending me letters making my situation even worse! I can ask them for copies of my statements from the last 6 years and then claim back my charges when I have calculated them? Also I was in a joint account with my soon to be ex husband who didn't really help financially as he could spend money like water and left me to struggle to keep out heads above water, I took my name off that account in December 2005, can I still claim back charges from that account too or am I not entitled to that as I no longer have my name on the account?

Hi all,
I would very much appreciate hearing your thoughts and experiences (if anybody has been in the same boat) with regards to reclaiming fees whilst being on a Debt Management Plan with the CCCS (or similar organisations that help you out when things go really pete tong).
I have a huge debt I am going to be very slowly paying off via a dmp organised through the CCCS and was wondering what my chances were if any of being able to reclaim old bank charges/fees whilst I am in such a situation.
I must have paid out hundreds if not thousands of pounds of the last five or six years whilst things have been on the boil and now I am not making my normal payments to them and am on a reduced payment through the ccs (which some of the credit companies involved still have not accepted), do I really stand any chance?
Should I approach them in the way of asking that they refund unfair bank fees, but ask that the amount be taken off my total owed to them? Is that something they are more likely to do? Obviously if I did manage to reclaim some fees it would all go that way anyway, but I'm not sure how to appraoch it due to my sitaution.
I have sent a letter to most of my creditors before and got the expected blunt refusal with no real reason as to why, just saying that they basically wouldn't be refunding them!
Any help on this would be appreciated, especially if you have been in a similar situation and sucessfully claimed, perhaps you could give me a breakdown of what you did and what happened as a result.
