  • hello, is there any one out there who may be able to help?, i have sent letters to my bank and credit card, to which i am awaiting a reply. Two years ago, we couldn't pay our overdraft, i wanted them to lower it monthly, like two hundred a month, they said no and told us a consolidation loan is best. We are now paying 117 per month for this, if they had let me pay off my overdraft i wouldn't have this loan, do you think i could claim for this loan they made us have?

    Hi Folks

    I am claiming from BOS, I have just filled in a summary clause form available online from the Scottish Courts website, This allows for greater claims than the £750.00 small claims limit up here, I wondered if anyone else has done it this way and if so was it successful, They had their LBA by recorded delivery and signed for 17 days ago yet I have not had any kind of response.

    Yes proceed as you were going to, as claims can be made even on closed accounts Good Luck :)

  • hi, I am new to this, only registered today with moneysavingexpert.com. so not sure if i am on the correct page. apologies if not.
    I am currently claiming 3.5K from Natwest, and have sent two letters (both recorded) and neither have been replied too. so am now in the stage of taking to court. and am feeling very worried and anxious as i keep hearing that natwest are the worst banks and will defend their claim. any advice please.

    Just a quick question - I am claiming for 3 visa accounts with the Halifax and will be filing with MCOL in the next couple of days but just need to know whether I can claim for all 3 accounts under one claim or whether I need to do 3 separate claims:confused: .

    Thank you very much for your help. Can I just clarify. I did send them a letter detailing the charges I occurred over the past six years. They then responded to say they would would repond in two weeks (which is what requested on my letter). The outcome now is that they have sent a letter saying 'that the office of Fair Trading has published new guidelines on credit card default charges. We're still talking it through with them, but the important point is that the guidelines are about 'default' charges that people pay when they break an agreement with us. This doesn't apply to your charges as these were for dealing with your request to go over your agreed overdraft limit. They are not default charges because you haven't broken your agreement. They are the prices for the service we provide in these situation.'

    I have no idea what this means and what letter etc I should send them in response. I am also confused that they refer to to my credit card as I want reimbursemnet of charges on my bank account which I gave them details of. I never made reference to my credit card.

    Any advice welcomed, please

    The sting is actually quite easy to rip out. It occured to me just now. Take each statement and starting from the top with the balance brought forward go through the transactions and compare it to the balance at the end to be carried forward. Any difference between these amounts not accounted for in the listed transactions you can quite reasonably attribute to charges.

    You will need evidence of the charges and so query any deficits in the statements. You will need written confirmation that missing transactions are manual interventions for your proof at court stage.

    The evidence is in the omission ;)

    Is there anyone who has received a request for further information from the bank's solicitors?

    My claim has now been allocated to a local court with Judge's name! Getting a little nervous now but want to make sure I do everything right. Anyone at the same stage out there?
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    You need to tackle this whole issue as a complaint and gather as much evidence against them as possible. The recall of the loan and overdraft is clearly in retaliation for reclaiming charges however much they deny it. I would ring them tomorrow and tell them not to telephone again and to put all communication in writing. You also put this in writing to them not to contact you by telephone. What they are doing is harrassment and designed to put you off reclaiming and the repercussions of their actions are serious.

    Make a written note of the phonecall for evidence as the begininng of your complaint. Tell them to put it in writing that they will be recalling the loan and demand they fully state their reasons why. In response you can state that the refund of unlawful charges is a large part of the overdraft they demand repaid anyway. The situation is frankly ridiculous and they know it. Once you have this make complaint to the bank and follow their complaints procedure. You will be playing the game by the rules this way and can eventually take full and documented in detail complaint to the Financial Ombudsman about the recall of the loan in this manner. This behaviour is disgraceful and the stress they are intending to cause is totally unacceptable.

    Bear in mind that any debt you owe to them is always negotiable for payment based on your income and outgoings. Dont panic, they can demand the recall of all debts but they cannot expect full payment immediately.

    Continue with your claim for charges, you have nothing to lose since they have already started harrassing you to bring the overdraft up to date and you cant. Play the game but get what is rightfully yours. Best of luck :)
