    Hi,
    I have today received notification that my case has been transferred to my local court (Peterborough);
    The form states that the "filing of an allocation questionnaire be dispensed with in this case unless the District Judge at the court of transfer orders otherwise" - is this because they are getting fed up with these cases and trying to save time? I'm not sure ...

    Also, in their defenhce, Barclays solicitor states that "the particulars of the claim do not provde details or particulars of the precise charges alleged to be unlawful" - well, he's right because the file I lodged on MCOL doesn't because there wasn't room on there, but I have sent them to Barclays SEVEN TIMES!!!
    Is this just their way of trying to throw me off the scent and catch me out ... 'cause if so, it's kind of working!!!

    The rest of their defence basically states that I agreed to their terms and conditions when I opened the account etc etc ... (blah blah blah), and is all wrapped up in a nice load of solicitor speak which is very difficult to understand ...

    Am I right in assuming that I will now have to wait for a court date, and if so, is there anything else that I should do in the meantime???
    Sorry for all the questions, but it's scary stuff now ... I keep thinking of my £2900 though and that's keeping me going!!!

    Hi Guys,

    HSBC Hadn't sent in their allocation questionnaire by the specified date, so i recieved a letter from the district judge giving them a deadline date for their submission stating that failure to reply by this date rendered me winning by default.

    The date passed and i hadn't heard anything from the court, so having called up they have told me HSBC has only just submitted their form and i now have a hearing date. Can they do this?

    Also, how should i now prepare a defence for my appearance in case a solicitor does show up on their behalf?

    How many cases have had somebody show up at court?
  • Just a quicky please:

    I have 2 accounts with natwest, account 1 had £170 charges and account 2 had £250 charges.

    i wrote letters for both accounts. reply to account 1 was a full refund of £170. RESULT! reply to account 2 was £180? i am obviously accepting the offer for account 1 but what should i do for account 2? why have they offered such a low offer when they have offered the full amount for account 2.

    do i have to threaten court action now for account 2 or shall i send another letter. if so, please could somebody start me in the right direction as, as you may see, i dont have a wide variety of vocabulary. thanks, sam


    p.s. the letter also says 'if you would like to discuss this offer, please contact us on the number above'. what should i say if i ring them?? thanks

    Put in a number of requests using template to reclaim bank/ credit card charges. Letters posted off on 5th March 2007- have had reply in interim from Yorkshire Bank to say they will supply statements but it will be outside the 40 days. First Dirct claim settled within matter of weeks- my statements were online.

    However hand delivered a letter to Barclays on behalf of my partner on 5th March- time up on Saturday- have heard absolutely nothing- any one had problems getting their statements and how long did it take?

    Had a letter this morning from DG asking for a full breakdown, a bit late?
    I'm gonna send it anyway, just so thay can't say I didn't respond!
  • Hi I'am a new claimer. I sent initial letter to the bank (Halifax) for statement details. I've had no reply. Rang the Bank got Call Centre They said letter not received. Told me to cancel Cheque and pay £5 over the phone for statements to be sent. Still not received anything. Martin's guide does not seem to cover this in much detail and not sure where to report this on the Commission's page.
    ANY HELP WOULD BE APPREICIATED NAVYFIRE
  • you should send all letters recorded delivery so they can't say they didnt recieve it. no you might have to try and prove that you paid over the phone!

    Does or will your claim include any issues under the Human Rights Act 1998?

    Sorry missed this bit out - but they have offered 50% of the charges back as a goodwill gesture - but they seem to be sticking by what they have said


    I'm pretty sure that it relates to ALL bank accounts, business or personal...
    I am quite looking forward to getting mine sorted out. Banks have been extracting the urine for FAR too long. Especially HSBC. I can't believe how they can justify £150 per month charges for an EMAIL, not even a letter !!
