About 2 years ago natwest charged me £270 over the course of a weekend, i couldn't afford to pay this and as a result they closed my account and demand repayment of my student overdraft. The account is now with a debt collector who won't send me a statement of the account and natwest say they are no longer dealing with the account. Is there any way of reclaiming these charges as I don't have the statements?0

Hi Folks,
I received a letter from my Halifax acoount acknowleging the reclaim letter I sent them nut now they inform me it will take 8 weeks to look in to it? Legally where do I stand and are they acting with in the law? Please help, cheers for your time,Jay (I think this is a delaying tactic???)0 -
Hi all,
After sending a letter to Lloyds TSB dated 3rd March i got my list of charges through this morning. Having checked through the lot, it adds up to 2663.27 including the interest. (having glanced through the other threads, i assume i cannot claim for O/draft interest & Account charge but everything else on the list seems fair game). After having struggled through Xmas and the last couple of months this amount would be a great help.
I shall be sending them a letter today asking for the lot back.
Could anybody else that's had experience with TSB let me know how long i can expect to wait before the cheque lands at my door?0 -
Hi Folks,
I received a letter from my Halifax account acknowleging the reclaim letter with figures and interest I sent them. The Halifax now they inform me it will take 8 weeks to look in to it, to assess the charges? Legally where do I stand and are they acting with in the law? Please help, cheers for your time,Jay (I think this is a delaying tactic???)0 -
Hi Savers!! I went Bankrupt because charges sent me into a spiral of debt during my time as a student
- they played stunts like taking money from my current account to pay my CDL Loan before I'd even left university, I complained they put it back - but because they had taken me way over my over draft I got charged extortionately for their mistake! Thanks for the sleepless nights Barclays!
I'm no longer bankrupt but can i still claim the previous charges? Also I had three accounts with the same bank (Barclays - yak!) would I have to pay a separate £10 to each of the accounts for the info required? And can it be paid by postal order (they dont allow ex-bankrupts cheque books).Thanx, & good luck all!!!!0 -
Halifax PLC
Amount claimed - £2306 charges + £663.34 interest + £120 MCOL fee.
Amount received - The lot! £3090.34
First letter sent 1/3/07 requesting statements. Received them 2 days later (no fee)
Sent off 2nd letter (requesting my money back) 5/5/07
A week later I had the usual "we have 8 weeks to investigate" letter.
22/3/07 - got bored with waiting and just started the MCOL claim against them for the full amount plus interest.
Halifax acknowledged the claim after 10 days stating their intention to defend the claim.
11/4/07 - the following letter was received:-
"I have received and have been dealing with the procedings which you have issued against Halifax PLC.
Your claim relates to bank charges debited from your current account. These charges were debited from your account in accordance with the terms and conditions which you agreed to accept and by which you are bound.
I have returned the form of acknowledgement of service to the Northampton County Court indicating that Halifax intends to defend your claim. However, on a purely commercial basis, it will cost Halifax money to defend your claim in terms of legal costs that will be incurred. It is unlikely that Halifax will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track, in which costs are not generally awarded.
For this reason, but without admission of liability, Halifax is willing to reimburse £2306 in respect of the bank charges incurred, together with £664.34 in respect of approximate interest that Halifax has calculated was charged on your account as a result of charges. The Halifax will also reimburse £120 in respect of the court fee.
This amounts to £3090.34 which will be paid into your account within 5 working days"
What can I say?? What a perfect result on this one.
6 weeks from start to finish and all it cost was £2 in recorded delivery fees.
I would advise ANYONE who has been charged to get in their claim. It's easy and you are certain to win. Don't accept any 'offers', just take them to court and get the lot back including interest.
Please get in contact if you need any help!
Cheers. Steve.
PS. That £3k is gonna come in handy as I am getting married in 3 weeks time!0 -
