Hi everyone
Just wanted to let you all know that Bank of Scotland did not respond to my manual county court claim. I've now entered judgement and await their response and £130 cheque. Only Natwest to go but they've stated that they are defending my claim. Not to worry though, it cost me £30 and should cost them hundreds with legal fees etc.

You don't need to do anything yet (and it won't let you get far anyway!).
You have to wait until the 14 days (or 28 days if they acknowledge the claim) are up before you can get a judgement.

I have started a claim against Halifax
2 years ago I signed up for paperless banking so I get all my letters, statements etc via email or when I log into my internet banking
So how can they charge anything for a returned cheque, DD etc as there is no cost involved?0 -

i recieved a letter back today from STUDIO after i had asked them to refund me nearly £200 in fees they have taken off me .the letter said i would have to send all correspondance to the collection agency that is now dealing with my account but surely the collection agency would have no dealings with how much STUDIO have overcharged me in the past so does anyone know whether i should re-send first letter asking for my money back to STUDIO telling them that this has nothing to do with any collection agency or do as they say and send any letters to collection agency

22/3/07 - got bored with waiting and just started the MCOL claim against them for the full amount plus interest.
Halifax acknowledged the claim after 10 days stating their intention to defend the claim.
11/4/07 - the following letter was received:-
"I have received and have been dealing with the procedings which you have issued against Halifax PLC.
Your claim relates to bank charges debited from your current account. These charges were debited from your account in accordance with the terms and conditions which you agreed to accept and by which you are bound.
I have returned the form of acknowledgement of service to the Northampton County Court indicating that Halifax intends to defend your claim. However, on a purely commercial basis, it will cost Halifax money to defend your claim in terms of legal costs that will be incurred. It is unlikely that Halifax will be able to recover these costs (even if the bank wins) because your claim will probably be allocated to the small claims track, in which costs are not generally awarded.
For this reason, but without admission of liability, Halifax is willing to reimburse £2306 in respect of the bank charges incurred, together with £664.34 in respect of approximate interest that Halifax has calculated was charged on your account as a result of charges. The Halifax will also reimburse £120 in respect of the court fee.
This amounts to £3090.34 which will be paid into your account within 5 working days"
What can I say?? What a perfect result on this one.
6 weeks from start to finish and all it cost was £2 in recorded delivery fees.
I would advise ANYONE who has been charged to get in their claim. It's easy and you are certain to win. Don't accept any 'offers', just take them to court and get the lot back including interest.

Can you claim back charges when the account went to debt collecting agency? The debt has been paid back but I belive that the bank must of sold the debt on. Thanks

Can anyone help? I have refused Lloyds offer of 50% of the amount owed in over charges, I wrote and told them I would accept 75% + interest
(£1,986.00) of the amount owed. Meanwhile on the 20 March 2007 the bank paid the 50% of the amount outstanding into my bank account. I sent a letter on the 26 March asking them to remove the amount as I had not accepted it, which they have ignored.
I have now received a claimant's reply from the court and Lloyds TSB say they dispute the claim as they have already paid th £750.00.
What do I do now?

I am new to MSE :j
I have calculated all my Bank charges which amount to to total of £4448.80 :eek: I have received a reponse to my letter which requested this to be paid back to me, telling me that the charges are lawful. I expected this as Martin explained in the process notes. I have now send my second letter threatening court action so im looking forward to receiving their reponse to this also.
Im just wondering if there are any others out there who have applied to the Ulster Bank for their charges and how they are getting on with it?
I look forward to hearing from a few people (fingers crossed)

Most of the cerdit card companies seem to be charging £12 a time now for late payments or going over the credit limit. Are we able to re-claim these as well, or is this considered 'reasonable'?0
