    Hey all

    I have successfully reclaimed my bank charges from First Direct (YAY) but the account I claimed on was defaulted and has obviously wrecked my credit rating (just went on Experian and this is the only thing affecting it). Is there any way to reverse this or get it cleared/reduced on my credit score? I really need to sort out an EVIL cahoot flexible loan rate but there's no way I'm going to get a decent rate with a big fat red mark on my credit rating :confused:

    If anyone has done this before or can give me some ideas I would really appreciate it (sorry if this is a many-repeat post)

  • I got the same 5-paragraph defence - it sounds like a standard 'cut n paste' HSBC defence which everybody has been getting. Also I got the AQ dispensed with too - this is becoming common practice as the courts know that the banks don't turn up in court and wish to reduce time to get the cases out of their system.

    Sit tight - from what I've been reading HSBC submit their defence, then drag it out a bit (hoping you'll lose your bottle) before finally offering payment through their solicitors.
  • Yet another opportunity for banks & credit cards to turn the screw. CCA 2006 states that from April 2008 lenders must not charge interest on charges (late payment fees, overdraft charges, etc) until a few weeks after the charges have been added to your balance. In the latest version of the act this does not have to be in place until October 2008, so .... the banks, etc can continue to charge interest on "fees" until October 2008. In the case of a certain financial institution ( to remain nameless) this represents an "income" in excess of £100,000 and changes to IT systems are being delayed to avoid losing this income.
    Will we be able to claim back interest charged during this period ?

    You can still reclaim these as the £12 is the figure based on what the OFT considers reasonable but is not a precise disclosure of actual cost. Until the credit card companies disclose actual costs in court they remain reclaimable under consumer law :)

    Dont worry it would have been forwarded to the complaints department anyway. They are treating all these claims as complaints apparently. It means they will stick to the timescales laid down by the FSA and say they will respond in 8 weeks but you can still stick to the timescales here and not follow theirs. Good luck :)

    My claim against the First Trust is for £1951 and with the interest of £ 702 would take it over the Small Claims £2000 band. Can i ask for the full amount of £2653 now and reduce it to the charges only if i need to bring it to court or do i have to decide on charges only and carry the £1951 from start to finish? Thanks.

    The limit for small claims in England is £5,000 so assuming you live here you are well within this so dont worry. You cant actually ask for interest before court though as it is only awarded by the court. If you are offered full refund -interest before any court claim you must accept it. Good luck :)

    I filled everything in this morning to ask for judgement by default and I just checked and it says my judgement's been 'rejected' and I can't go any further online, it doesn't say why.

    What does it mean? :confused: Does anyone know??
  • Got home from work and received a letter from Natwest's solicitors requesting my bank and sort code details - is this not something they should get from their clients (Natwest) and should I really be helping the opposition?

    Please help!!!!

    Going through the process of claiming £1,800 from Barclays, asked for back statements, sent letter to bank asking for money to be returned as per template. Letter received letter today stating they are sorry I have complained and are looking in to it.

    I guess they are stalling until the result of the court case tomorrow by that young lawyer against his bank which will determine if bank charges are illegal or at least if they can be claimed back, or have I got that wrong?

    Regardless of the outcome thanks to this great site, lots of people have reclaimed what is rightfully theirs, well done Martin.....I guess the banks must bloody hate you!!!!

  • Requested statements in February, wrote 2 standard letters, got the usual fob off letters back, issue small claims court beginning April. Abbey have just acknowledged court claim. Beginning to loose my nerve, really don't want to go to court!!
