help advice plzzzzzzz
i bought a car from a garage picked it up the day the details in paper said cd among other things when i got the car its a tape cassette no cd player its all set up to work a cd just needs a cd changer when i priced them i have to get the right make for the car which is a fiat and will cost me £220 i paid 5,000 for the car should they supply a cd changer cause it was advertised in the paper0 -

I am just trying to reclaim charges now. Lloyds TSB have refused to refund £270 in charges via letter- should I now take them to court via moneyclaim.gov? Also, Barclays are making excuses about not sending me statements for the last 6 years. It has been nearly 7 weeks since I first asked them. The charges here could run into the thousands. Thanks for any advice anyone has for me0 -
Hi, Abbey have put a defence in and a court date has been set. Can anyone help as to what I need to bring with me to court just the statments of all the charges?
I would take your statements, a summary of the charges (with interest if you're claiming it). I enetered the details from the calculator on here into an excel spreadsheet, to make it look a bit neater.
Also take any letters to and from your bank. I also plan to take (if it ever gets that far) Letters notifing me of going overdrawn, for various reasons, ie. ask them what the letter costs, ask them where they have provided a service they alleged to have provided etc etc.
Take whatever you think you will need. If you take too much and don't need to present some of it, so be it. If you don't take enough you can't exactly 'pop out to get it'.
Now, just wondering if anyone can answer my question?
If it goes to court, do I have to pay all of these fees???.....Starting your claim

£1,000.01 - £5,000 £120
Preparing for trial
Allocation to track:
claims for money of £1,500 or less no fee
all other claims £100
Trial fee:

I'd be a little concerned if I had to pay all of them up front, its quite alot of money!!
Also could someone tell me which court I would use?..

All the fees listed as payable up front are subject to exemption if your income warrants it. Scroll to the bottom of the page hre to see if you are eligible for exemption:

If you arent then they are payable back to you as costs when judgement is found in your favour. If you only have one claim to bring your costs will be £230. Also bear in mind the recent posts on the site where an Allocation Questionnaire has been deemed unneccessary by some judges so saving you a further £100. If the bank does not enter a defence, again this fee is not payable. Ifs, buts and maybes reduce your costs considerably
As to your local court if you file online with MCOL it will be Northampton by default and then be allocated to one of those local courts for you. If you claim manually I should think it would be the magistrates one but I could be wrong and someone in your area may be better able to advise.

With Lloyds send the LBA (letter before action) and then yes I would file via MCOL. As regards Barclays write and advise they have breached your entitlement under the data Protection Act to receive this data within the 40 day statutory time period. You can complain to the ICO about this but it may speed things up simply just to threaten Barclays with this action. Good luck in both cases0 -

Its a bit off-topic for this forum but I will answer this, I hate to see people ripped off like this. Take the car back today and either : ask for a refund of the cost of a cd changer or demand one is installed within a set time. I dont know about a small claims court option but at the very least you can complain to the Trading Standards Office for false advertising and the threat of this should shift them. Take along a copy of the advert in print as written evidence

There is no such thing as a small claims court, the cases are heard in couty court on a 'small claims track.' So there you go a bit of definitionWhat is cool though is as stated in the article:
You can claim at county court for money owed to you (by a tenant, landlord, bank or utility company for instance), bad workmanship, damage to property, road traffic accidents, personal injury, goods or services not supplied or faulty goods.
So you have this option now also. Best of luck getting what you paid for0 -

I have a catalogue with Choice for you who are under the Littlewoods Home shopping group and have written to them with first two letters. I didnt receive a response to the first but had a response to second but was from Shop Direct financial Services who are the company that provide the credit to catalogue companies. They just said are investigating my claim and will contact me once investigated however they didnt give a timescale.
As I want to start MCOL who do I put claim against, choice for you, littlewoods home shopping or shop direct financial services?0 -

I am trying to claim my money back from HSBC with regards my Mastercard - I have had an offer in the post this morning for £138.00 and I am claiming £296 plus interest - I phoned the number on the letter to try and up the offer but have been advised that I need to write in again saying that I do not accept the offer and they will refer this to management - which I am going to do today and send it off special delivery as I have only given them 7 more days - in the letter they state that they are going to credit the amount back to my account but I would really like to take the money as a cheque so I can decide for myself what I do with this money.
Is it standard procedure to credit this refund back to the Mastercard or can I ask for it back as a cheque.0
