Can anyone help me ? How much does it cost the bank if I refer it to the FO ? Not sure if its £300 or £350, brain doesnt want to remember. I need to know for a little stinger in a letter to go off later this afternoon so I'll just keep checking back to the forum for any reply. Thanks in advance :)
  • i notice in the news today that a chap has taken natwest to court not just for the charges but for to claim 'EXEMPLORY DAMAGES' -He ran up £2,500 in penalty charges while studying law and is demanding the right to claim exemplary damages - punitive charges levied when the defendant's wrong is deliberate, malicious or negligent - on top of the cumulative cost of the fees.

MY QUESTION IS THEREFORE IF THE BANK DEBITS A CHARGE ON YOUR ACCOUNT AND THE MONIES TAKEN ARE - CHILD BENEFIT OR DISABLEMENT PENALTIES- THIS SURELY IS NOT ALLOWED I DO REMEMBER A THREAD SOME WHERE REGRDING THIS BUT CANT FIND IT.

I AM CLAIMING REFUND OF CHARGES ON MY ACCOUNT AND THE ONLY ITEMS PAID INTO THE ACCOUNT IS CHILD BENEFIT AND DISABLITY BENEFITS WAR PENSIONS. THE BAK REGULARLY CHARGES A 'NOTIFIED FEE CHARGES OF £75.

EFFECTIVELY THE BANK IS DEBITING THESE PROTECTED BENEFITS THEN???

THINKING OF GOING TO COURT NOT JUST FOR THE CHARGES BUT FOR THE OFFENCE OF TAKING THE BENEFITS WHICH I BELIEVE ARE PROTECTED UNDER LAW.

DONT KNOW WHAT THE LAW IS BECAUSE I CANT FIND WHERE I FOUND IT IF YOU KNOW WHAT I MEAN.

If they go over the 14 days carry on to the next letter. Always stick to the step by step guide and your timescales. They would have you waiting months if they could!
  • I have put a claim against Nationwide into the small claims court for £2087.30, my charges with interest. They had the intention of defending the claim and had until monday 16th April to reply. Instead they have credited my bank account today with £1681.00, my charges without interest. I fully intend to get the interest (£406.30) and court charge of £120.00 back from them, but how do I go about this? Can I still continue with the small claim, as I am not asking for the full amount anymore, just £526.30.

    Thanks, Jo

Hello everyone! I have thoroughly browsed the messageboards for an answer to my question but I just can't seem to find one. I wonder if anyone can help.

I have set up a parachute bank account and I am now ready to attack HSBC with my bank charges letter. I have worked out how much they owe me but I just have one small query.

The intial letter to the bank asking for my money back should include details of all charges - how should I list these? Do I need to put them in a table or something with the amount, what I was charged for, etc.? I am just a bit confused as to how to give them this info.

I hope this makes sense and I would be very grateful for any guidance. Thanks - Emma.

    Hi Emma!

Are you charging for interest also? If so, just use the print out from Martin's calculator.

If not, just send a list with the date and the charge :)

Emma, a table of the charges is what you need. List them with Date, Charge Name, Amount for each one and a total. Send this with every letter to the bank.
