    From what I gather, the 28 days does include weekends and bank holidays (it's not your fault if a bank holiday falls in that period).

    With my MCOL claim, I was told what date they have to put in a defence by. I would check with MCOL to see what they changed that date to on the basis that the claim was acknowledged.

    In dealing with the bank directly, I did give them the benefit of the doubt in regard to Bank Holidays, but I don't see any reason why a court would do likewise.

    Hopefully, someone with a bit more knowledge of the system may also quantify/clarify what I have just said.

  • I have another question (first one still awaiting response too.) :-(

    My account is still registered at my mums house even though i dont live there. However my local branch is not the same. I live approx 95 miles from the address my account is registered at.

    So when i get round to sending my first letter does it need to go the one near my mum's house or will the local branch where i live surfice. (i will be changing my address with them when i move in to my new house at the end of this month) Or would it be better to wait until i have changed my address

    Hope all this makes sense.

    What was your first question ? I'll attempt an answer :)

    In answer to the second above, the local branch is literally whichever branch is most local to you so the one where you live is fine. Obviously let them know your change of address when you move but there's no reason why you cant start now.
  • i am currently trying to get charges from lloydstsb, they have ignored my letters so i am now going to court. on the online claim form it requires an address for lloyds, however the one they gave me is not in england or wales and so the form will not recognise it. is there another address? shall i simply put down my local branch address or will this then somehow be used by the bank and invalidate my claim?

    Hi All,
    i'm with Natwest, has anybody ever recieved a letter from them telling them they won't be sending anymore letters out telling you when they are going to charge you for not paying a "DD", & just apply the charge to the account.
    I'm sure i had a letter from them telling me this, as the last time a DD didn't get paid, it wasn't untill the company claiming the DD informed me that it had been refused that i knew anything about it & i have not had any letters from the bank.
    This being the case, they are ripping us off even more as they havn't even got the cost of the paper & stamp to fork out for.

  • I have been in the process of claiming my charges back since nov 06 and have now had togo down the court route we filed papers on the 15th Jan 07 and have now got to go to hearing .

    My bank did not provide me with my bank statements until today after writing to them 5 times and asking for them to be forwarded to me in the end i went into my bnranch and got the manager who ordered them for me and waivered the £10 fee.

    Now I am waiting for a hearing date to come through with in the next 6 - 8 wks it is very scary having to go to court but the bank left us no other option the easy part is filing the papers the scary part is when the court say they have lost all your paperwork twice and then found it where it was suppose to be.

    The best part about this whole thing is that on Saturday 7th April 07 i get a letter from a collections agency saying that my bank has sold on my debt while it is the process of going to court.

    I have been telling everyone to reclaim there charges back from the bank and every single one of them has received a full refund, guess I'm not that lucky:mad:

    Something tells me they were not suppose to do that from the conversation i had with one of the collection agency employees.;) ;) . it can be very tiring going through the courts but hopefully it will all work out for the best any information or advice anyone can give would at this point be very helpful.

  • yes you can but be careful i did that and the account that got opened was not what i wanted. so yes you can open account online but they will still need to send you all your paperwork to sign
  • I have a lloydstsb account and they sent me a letter stating that they were reviewing all there charges given to customer and offering them all refund they refunded mine after 1 letter if I can help you in anyway let me know
