Hi please can someone help?
I have written to my bank (Barclays), on Saturday 31 March with an initial claim for bank charges stating further action if not replied within 14 days, I have recieved today Friday 13th April a reply that they have recieved my complaint. In their letter they state that they will respond no later to the query than the 3rd May and also enclosed a leaflet on how they resolve complaints - there is no reference made as to the nature of my complaint.
I am not sure as to how to continue do I wait until the date they give or do I carry on with my time table for follow up letter?

from what i can gather and from what we have done is that you call the shots regarding time scales and not the banks, it has always been stated that as long as you have given the banks enough time then thats good enough, the time scales we used was the ones martin publish on the first page where it tells you about how to make the claim0 -

i am currently waiting for the 14 days the bank has to defend their case to be completed.
however, i received a letter YESTERDAY from my bank. it was a reply to the second letter that i sent them. it made me chuckle as i filed with money claim on 5th April!! (the 14days takes easter in to consideration).
i think this has happened because i have been sending my lettters and filed my claim using my local branch address and not the complaints apartment......halifax: settled paid £2622.18:j

My fiancee decided to try and reclaim his bank charges in February. The final straw was £187 worth of charges in one month(the same month that we had been in hospital whilst I had a baby and pretty much ignored any payments that were due to go out). We wrote a letter asking for the 6 years worth of statements, and as Lloyds had told us, we dropped it in to his local branch. 21 days later he recieved a letter saying that as no cheque had been included in this letter(we didn't really know what we were doing), they had a further 40 days to respond from when they recieve it. We sent the cheque out the same day(06-03-07) but as yet-70 days later, we have still had no statements sent and when he checked online-the cheque hasn't even been cashed.
Is this just Lloyds messing us about because we didn't send it recorded delivery?
Should we start again with a recorded letter and cheque or proceed with the second letter? Any help would be great.0 -

Does anyone know the phone number to chase egg for statements? I requested them on 17/01/07, they took 26 days to as for I.D, then sent a letter on 15th March saying 40 days would start then, i am however going on 40 days from them receiving my I.D. From the time you requested statements they had 40 days to give you them, if you have not received them and 70 days is way too long you need to complain to the ICO Information Commision Office and they will sort it out for you, It all adds to the time taken to claim your money back but stay strong and you will get it back eventually, I've got my own tale but will write that in a minute:)BORN TO RIDE - FORCED TO DRIVE

Sorry Adele I don't think I read your post correctly, When I did my letter for statements I handed them directly into the bank, therefore they had no excuses that they had not received my request, It still took 42 days, this was with BOS, it might be worth your while starting again with the initial letter and making sure they have received it i.e. in person or by recorded delivery, it would be worth your while if you are new at all this at taking your time and studying all the threads:)BORN TO RIDE - FORCED TO DRIVE

I'm resending these two questions in the hope that someone will be able to help before the court date (fast approaching!!)
My partner & I are reclaiming from the Abbey!! They are holding out and a court date has been set. I have two concerns...
1. The court papers state that we should send copies of all documents to the court and 'every other party'. Does this mean that details of all the charges plus interest should be sent (again) to the Abbey and also to the Court? Should we be sending anything else and/or re-stating the arguments?
2. When we first wrote to the Abbey they offered a sum amounting to around 25% of our claim and, without waiting for a reply from us, credited that amount to our account. We wrote back accepting the money, without prejudice, as part payment of our claim. I am wondering now whether this was the right thing to do and whether it might 'muddy the waters' and enable the Abbey to win on a technicality.
Any comments or experience of such issues would be appreciated.

If the court are asking for all documents then you should send copies of all letters sent plus charges etc to all parties i.e. the Abbey, as regards the abbey giving you 25% of your claim, as long as you have stated that you have accepted it without prejudice and not in full claim, that's fine the fact they have given you anything means they are accepting liability, stay strong and good luck. you will get there in the end.:)BORN TO RIDE - FORCED TO DRIVE

Well I'l be posting a second letter to Lloyds tomorrow. I am being nice and offering that they may settle with a slightly lower amount than I have originally asked for. If not I'll be taking them to court and claiming the full amount.
PS. Anyone asking about where you write to etc. make sure you send all your letters Royal Mail recorded delivery. Then you know they have been received. You can also go on the Royal Mail website and print off a proof of delivery, with the recipient's signature, a few days after it's delivered.

I've just started court proceedings, but did not initially claim interest from the bank and submitted a schedule to them without the interest showing. Now that I am claiming interest through the courts, should I send another schedule to the bank showing the breakdown, or is this not necessary as the wording on the online court submission gives the total interest figure I'm claiming for?
If it is best to send another schedule, should this be done now or when I return the Allocation Questionnaire?
