I have gone through the process of getting my mortgage statments from the Kensington. They were quick to supply me with these. I calculated that with interest I am owed £759.14. I am claiming for monthly penalties they added for being in arrears and also returned direct debit fees. I am treating this in the same way as a bank account, and hope that I am right to do so. I have asked for the amount to be refunded to me. I have been told as the banks all seem to, that all fees are in line with the companies T&C's. I have threatened court proceedings and been told that they will defend strongly. Yeh so do you all !!! I have since on the 11th of April issued a claim with MCOL. It will be served in 5 days Max, they then have the 14 to respond. This means they have until midnight on the 30th of April. I have trawled through the threads and have not seen anyone who has pursued a bank for fees applied to a mortgage account. I would be gratefull of any comments or past success or failure storys. KEEP FIGHTING
I am also chasing Woolwich Direct Mortgaes for about £3642 for roughly the same as above, I have got to the point where I have asked for the money back. Still waiting a reply, only a few days so lets wait and see.
Alliance & Leicester I've calculated owe me about £3442 Current Account charges, as with the Woolwich I'm waiting for the response to my request for my money.
Lloyds TSB are being hard work at the point where they have been threatened with th Information Commisioner.0 -
I didnt think this question would proove to be so difficult to answer. Does anyone know how long it takes the county court to set a date for a hearing after they have cashed the cheque? They cashed mine on the 4th April.

hi everyone, i sent my first letter to bank asking for money back with my marriage certificate as im seperated and using my my maiden name but am claiming on joint account, yesterday i recieved my marriage certificate back and a note saying your claim is being processed and an offer letter will be sent shortly, im due to send next letter on monday threatening court action shall i still do this? and if id o is it then 7 days then i go on moneyclaim? sorry for being dizzy!! can anyone help please:0 -
i dont know if this has been asked, but i am a little confused.
I have got my statements back and highlighted all the "paid referral" items.
my question is. What does "Unpaids out" mean on the statement and do i need to highlight them too?

Hi i have been reading this site for a few weeks now and the post are very pleasing to read but is it just me and my partner that sit here at night thinking we will be the first people that will not get the money back?
we have started MCOL and now they are defending the whole claim,we are starting to panic a bit now as i have been reading things about questionair's and having to go to court has anybody else had the same response from HSBC and if so can they shed any light on time scales and what happens next?

"I went to court today against Barclays. I have followed each of the steps through as guided by the site,
I was offered £300 initially but rejected it as my claim was for £800. I was always hoping that a better
offer would come through but nothing arrived in the post on Saturday so off I went to court today.
I felt confident as I am not the defendant, nothing was going to happen to me and the worse thing
that the bank can do to me is close my account and as suggested I have opened another one ready.
So I arrived for my 10.30am hearing on my own and was surprised to read that for court 6 that I was
due to go into that there were 10 other claimants ready to do exactly the same thing, 3 had brought
a legal person, maybe there cases were larger I do not know but 3 of us went for it alone, 4 did not
show, maybe the occasion was too much for them. The cases were against Barclays as well as others,
no banks turned up to any, we all went into the court and each had our turn.
The facts were there, heres my bank statements, this what they have taken, I agree that I have not looked
after my account, that I do not disagree with, but I used Martins words and said that the amount that they
took is not proportionate to the work of an automated letter and franked envelope, the judge asked what
did I feel would be appropriate and I said £2.50, which he agreed, so my 38 payments were timesed £2.50
and that was taken off of my claimed amount and I was awarded my £800 there
abouts as I had paid £80 in fees to the court. They were pleasing words to my ears when he said I find the
judgement in your favour, the verdict will come in writing, I will write to my bank giving them 7 days to pay
and if they do not I will instruct bailiffs to get the money back for me. The judge said I would probably
have to get the bailiffs in.
The judge seemed fair and obviously been through this many times previously, so do not worry, go for it, I
went to work for 8.30am left at 9.45am saying I had a appointment and would be back asap, my court hearing
was for 10.30am and I was finished by 11am and that was with 2 people being seen before me, I left and was
back at work for 11.30am with no one any the wiser of my adventures.
You really have nothing to lose. This sight has been marvelous as whenever I felt in doubt I would return and
read some useful fact and see that someone has already been there and done it."
this post certainly reassured me as i was beginig to get really sacred of having to face the bank in court. at least now i have an idea of what to say and how much to sugguest is a reasonable amount!!halifax: settled paid £2622.18:j

After no response to my first letter, I have, this morning received Nationwides standard letter of refusal, after sending my 2nd letter, i.e. in line with T&C's etc. I am trying to contact them by phone this morning, but guess what, their lines are engaged!! They say to refund me is not fair to other customers who's charges stand!! If I get no joy this morning it's " Hi Ho, Hi Ho, it's off to court we go, with a case so strong, it shouldn't take long, Hi Ho, Hi ho"!!!!!

I've just started court proceedings, but did not initially claim interest from the bank and submitted a schedule to them without the interest showing. Now that I am claiming interest through the courts, should I send another schedule to the bank showing the breakdown, or is this not necessary as the wording on the online court submission gives the total interest figure I'm claiming for?
If it is best to send another schedule, should this be done now or when I return the Allocation Questionnaire?

i would've thought that you could include it when you have to send all evidence to the court and the bank (providing you get to this stage) and state that you are now claiming interest due to the time taken and uncooperative nature of the bank in trying to settle this claim........halifax: settled paid £2622.18:j

Im currently in the process of reclaimin my bank charges back from Lloyds TSB. so far, i have rec'd my bank charges from them for the last 6yrs. i have added it up (without interest) and sent them the letter stating i'd like to have the money back, totallin £1,420.
today i rec'd their relpy tellin me that they have rec'd my complaint and were sorry to learn how i feel:-)..they would carry on with their investigation using the information i'd already provided and expect their enquiries to be completed within the next 4wks. in the meantime, they've suggested i take a look at their 'Voicin ure concerns' document they'd attached with the letter.
just wondering if anyone else rec'd such letter and what was the outcome??
