have you signed anything accepting the £750.00 offer?
if you have it is tricky to get the rest back.
if you have not, just ignore the offer and instead forward the letter/s to and from your bank to the Financial Ombudsman Service (google them for the adress) this will ensure you get a full refund and you wont have to go to court either. The Ombudsman has the power to force the banks to refund in full or go to court, they wont go to court cos they will lose so they will have to refund all the charges.
Stick to your guns

I have sent off for a list of my charges using the statement on this fantastic website, but as yet have not heard anything (33days). My reason for posting is because my account is with the collections department and I have a repayment plan set up with them. I noticed that some banks have started to reduce overdrafts etc so i renewed my payment plan for another 6 months to stop them havin gthe money back. Will the fact that my account is with collections affect my claim, I have the same situation with my halifax credit card which has been passed over to a debt management company can i claim for this and if so how do i go about it as i do not have my account number etc anymore. Be grateful for your advice and help0

They've offered me £750.00 and say they are crediting my account with the money within the next 10 days. It'll clear up the £500 overdraft I currently have (due to the charges, I've not paid any money in or used my bank account for DD's etc since January) but I just don't think it's enough.
So, my questions are these:
As they've said this is in full and final settlement, can I still take them to court?
As I don't have the £120.00 to take them to court for another couple of months, do I have to start it all again?
What happens with the money they're putting in my account? I want the full amount!
How do I proceed? Do I take the £750.00 off the total I'm claiming and do I write to LloydsTSB?
I apologise if these questions have been answered before, I've trawled through 30 pages of this thread and can't find what I'm looking for!

In fact, have a read of the Lloyds thread and you'll find that the £750 "goodwill gesture" is a standard reply from Lloyds and the money will be credited to your account in due time, in some cases without notification.
What you need to do now is write back to Lloyds and say to them, thank you very much you'll accept the £750 in partial payment and without prejudice but will be proceeding to court within 14 days for the remainder of your claim.

Hi,
I am requesting £920 from HSBC, which includes an £80 court fee and £180 interest. After following all the necessary stages of the process, I have a week to go for HSBC to enter a defence (they have already acknowledged the claim). Yesterday, they wrote to me saying that they would pay all but £60 of they fees which they claim have already been refunded - they haven't. They are also refusing to pay interest and have not included a refund of the court fee - It is only as a result of the taking it to court that has promoted them to reply to me.
Should I write to them to negotiate a revised amount and if so, how will this affect the 28 day court date or should I ignore their offer and continue to see if they enter a defence next week?

Sorry Adele I don't think I read your post correctly, When I did my letter for statements I handed them directly into the bank, therefore they had no excuses that they had not received my request, It still took 42 days, this was with BOS, it might be worth your while starting again with the initial letter and making sure they have received it i.e. in person or by recorded delivery, it would be worth your while if you are new at all this at taking your time and studying all the threads:)
We did hand the letter in personally at the bank but the cheque hasn't been cashed and we have no proof of it ever getting there. I think we will just have to start again with the recorded delivery thing. I have spent a fair bit of time looking through this site and have a much better idea of how it all works. Its just so frustrating waiting so long. Its amazing how quickly they're in touch with you if you owe THEM money!!! Thanks for your reply caleyes0 -

Please can someone advise me or send me to a similar post as i have spent ages looking and cannot find a similar one.
Basically, i sent all the usual letters to HSBC claiming for two seperate accounts - One account was for £795.62 inc int and the other for around the same amount. I started two seperate claims for each account on the 05/04/07 - They acknowledged it on the 12/04/07.
I received a charge on each of these accounts before claiming through MCOL on 17/03/07 which i went ahead and included in the claim.
However, my problem is, while going through info last night and for some reason checking online banking, i discovered i had mixed up the 17/03/07 charges, basically putting the wrong charge for the wrong account on each!! Arghhhhhhhh
Im dreading that HSBC will now get both claims thrown out as information is incorrect???
I sent a letter to Northampton Courts by recorded delivery this morning basically giving them my charges summary for both accounts and explaining my mistake. Should i have done this?
I am having serious doubts over whether i have handled this problem in the right way and would appreciate some advice? Pleeeease?0 -
Hi can anyone give me some advice, after going through all the stages of claiming my bank charges back from lloyds tsb i filed a claim with mcol.The 14 days are up today for them to file a defence.TSb havnt filed a defence and im not sure they have acknowledged the claim.What do I do next?0

Court date set for July 2nd. I'll read letter again carefully tomorrow. I get that I am supposed to send the other party (BARCLAYS) copies of all documents for the case.
It also suggests that both parties should try to reach agreement before going to court. I wonder if I should write to Barclays and say that in light of the courts request I will accept payment before court and forgo the interest the court would award. They may well ignore me so I wouold have to state that on such and such a day (say 7 days) I will assume they do not wish to take up my offer. Such communication would then form part of my documents of evidence to show that I have tried to reach agreement.
Is this a useful strategy do you think?0 -
Im just about to go through mcol for charges from the Halifax. My request has not included interest so far. Now im at this stage with no offer from them can I add interest now as part of my claim or do I need to stick to original claim amount with no interest?0
