I started the process and sent the letter informing LloydsTSB that I will claiming back my charges. I got a 'canned' reply and then sent them the 2nd letter, to which i got no reply. Unfortunately I wasn’t able to start court proceedings due to a lack of money. I am able to start this now, but should I contact the bank again or just start the court stuff??
you could send the bank a letter informing them that "as you have given them ample time to respond and have not had any further contact from them you are now proceeding through the small claims court"halifax: settled paid £2622.18:j

Court date set for July 2nd. I'll read letter again carefully tomorrow. I get that I am supposed to send the other party (BARCLAYS) copies of all documents for the case.
It also suggests that both parties should try to reach agreement before going to court. I wonder if I should write to Barclays and say that in light of the courts request I will accept payment before court and forgo the interest the court would award. They may well ignore me so I wouold have to state that on such and such a day (say 7 days) I will assume they do not wish to take up my offer. Such communication would then form part of my documents of evidence to show that I have tried to reach agreement.
Is this a useful strategy do you think?halifax: settled paid £2622.18:j

The "norm" seems to be that they send you a cheque. However, a few people have found that some banks have deposited sums of money in their accounts, so I'd keep an eye open.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
hi everyone,
At the moment i am currently doing a moneyclaim for abbey for charges of 4131. They have sent a letter stating they need a full list of the charges i am claiming for. My partner thinks i shouldnt send them the list back as they already have it although they are stating they havent, any advice please
thanks

It's obviously delay tactics ... I'd do as they say to prevent further delays, but "politely" point out that this has already been sent. Also, remember to send it Recorded Delivery.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
Thanks ever so much, I hope it is a cheque!! xx0

I would say that in fact the "norm" is usually that the money will be credited to the account that the charges are being claimed from rather than sending a cheque.
Best to check the thread of the bank you are claiming from.0 -
hmmm, where do I find a natwest thread please? Thanks0

Hi there am new to this...so would appreciate some help. Have recently sent Halifax my 2nd letter threatening court action if they don't pay up. Would be very surprised if I heard anything positive from them in response to letter tho. They have another 9 days .....that's until MY time limit runs out.......Can anyone help me with this ......if I have to go to next stage...MCOL....is there a part in the form that would exempt me from paying.......I am on benefits....or is this something that I would have to do thro the courts...:o0
