You can claim 'overdraft excess fee charges'
as for
'account charges', if this is an ongoing charge, something that you are charged every month you CANNOT CLAIM THIS.
hi there,
ive gone back thru and had another look, the £10 charges were taken out every month for a while, but having looked its always when ive had direct debit returned or standing order.

have you signed anything accepting the £750.00 offer?
if you have it is tricky to get the rest back.
if you have not, just ignore the offer and instead forward the letter/s to and from your bank to the Financial Ombudsman Service (google them for the adress) this will ensure you get a full refund and you wont have to go to court either. The Ombudsman has the power to force the banks to refund in full or go to court, they wont go to court cos they will lose so they will have to refund all the charges.
Stick to your guns
good luck
Hiya,
I've not signed anything yet, I was shocked to even get an offer. I'm now not so shocked as it seems a standard thing for them to do, to get out of paying the full amount.
I've been mulling it over since I received the letter and was going to just accept the £750.00 'cos I could really do with my account being back up and running with a few quid extra, but I'm not going to accept the £750.00 as full and final payment!
Thank you for the advice.0 -
hi every1 i hope someone can help me with this. i have writen to the bank asking them to repay my charges that they took. i have recived replys but nothing along the lines of me getting anything back. i have just paid my court fees online at moneyclaim. what do i do now the process is in swing and how long should it be befor i get a reply or even how much longer befor the give me my money back? any replys would be great thanks.
having read the success thread i think it depends on you bank and amount claiming as everyone seems to be treated differently. for example, i'm with the halifax and they seem to be settling larger amounts on the very last day they have for defence and avoiding court on the smaller amounts.....but not in everycase.
because of this it's very difficult to say whether you will have to go to court or not!!!!halifax: settled paid £2622.18:j

Hi there am new to this...so would appreciate some help. Have recently sent Halifax my 2nd letter threatening court action if they don't pay up. Would be very surprised if I heard anything positive from them in response to letter tho. They have another 9 days .....that's until MY time limit runs out.......Can anyone help me with this ......if I have to go to next stage...MCOL....is there a part in the form that would exempt me from paying.......I am on benefits....or is this something that I would have to do thro the courts...:o
as far as i am aware you might not have to pay because your on benefits or you get it reduced you may have to contact court directly by phone or pay them a visit0 -
Edinburghlass wrote: »In fact, have a read of the Lloyds thread and you'll find that the £750 "goodwill gesture" is a standard reply from Lloyds and the money will be credited to your account in due time, in some cases without notification.
What you need to do now is write back to Lloyds and say to them, thank you very much you'll accept the £750 in partial payment and without prejudice but will be proceeding to court within 14 days for the remainder of your claim.
If you are on benefits or low income you may be exempt from court fees, have a look at the Reclaim Help Thread, linked in my signature where you'll find a link regarding this.
Thank you.
I'm a little confused about the interest though. When I started I added the statutory interest to the figures.
Now I'm accepting the partial payment, there is £300 in charges (without interest) outstanding, which I'll be going to court for.
How do I add the interest to the remainder?
As it says "from the start of when you were first deprived of the money"
I've taken the £750 off the whole amount including interest (£1,138.87) Which would leave £388.87. Which I presmue is correct.
Sorry to sound thick! I've looked on the threads you've suggested but can't see this scenario anywhere.0 -

I am 99.9% sure that the account charge is a 'service charge' and something you cannot reclaim. If you are still unsure I would give Lloyds a bell tomorrow and ask exactly what the £10 is for, if it is for a service then no."He's a maniac, maniac that's for sure,
He will kill your cat and nail him to the door"

I personally wouldn't use a 3rd party. You'd be paying them for their services when really, it's very quick and easy to do yourself. It's only a matter of writing a few letters and waiting for replies.
Actually, it annoys me that people are out there trying to gain money by this means. They make it sound harder and more intricate than it actually is. I've had a few "offers" from companies lately.
But, each unto their own!0 -

i feel that the bank has taken an unfair charge from me which is money that i've worked long hours and stupid shifts for and i'll be damned if anyone else gets a slice of it!!!
however it is really a personal choice. if you really feel you don't have the time, what about a friend you trust who could be doing their's at the same time???
any questions you have can and will usually be answered by people on this site!!
