    Hi, I am new to here but thought it the best place for help on reclaiming my bank charges. I have a basic Halifax account, just a cash card, no overdraft etc.... I am always being charged for failed direct debits at 39 pounds a time. Recently charged that for a 5 pound direct debit. I cannot go overdrawn unless its the bank that wants the money and then I do because they take the money they want. Am I right in claiming all of these charges back. It is only these charges that I get for failed dd's but there has been quite a few in the past 6 years. Thank you in advance.
    yes you can claim these direct debit charges and any unauthorized overdraft charges (the £30 ones)
    halifax: settled paid £2622.18:j
    lloyds tsb: £1038.83 inc interest, but claim on hold.
  • :confused: It seems Halifax are really trying to make reclaiming charges as difficult as possible.
    I managed to get my bank charges back really easily, they didn't even write with an offer, they just called, made me an offer, I refused but suggested a higher offer (I was only owed less than £300 in total though) and they agreed. It was in my bank account within the week.
    My credit card though isn't going so well. I wrote to them asking for my money back (less than £800 including interest) and they have sent me a letter saying it clearly states in HBOS terms and conditions that charges are applicable in these circumstances (late payments only) and therefore I will not be receiving a refund! So it seems I'm onto round 3!
    My friend though is unable to obtain copies of statements. She wrote to them, gave them 40days, when it had passed she gave them a call and was told they had lost the documents she had sent. When she asked for them verbally was told it would cost her £100!!!!!
    I have advised her to call again quoting Freedom of Information act as they haven't even refused her in writing.

    Any other suggestions for either of us????
  • Forgive me if Ive missed similar posts to this posting just need some help and advice has anyone successfully won against their credit card charges (Barclaycard)and do you use the same template as the bank charges and the same procedure.

    With my MCOL claim, I was told what date they have to put in a defence by. I would check with MCOL to see what they changed that date to on the basis that the claim was acknowledged.

    Hopefully, someone with a bit more knowledge of the system may also quantify/clarify what I have just said.

  • I have a monument c/c which is run through barclays, i rang them up requesting my statements, to which they replied it would cost me £5 per statement thats over 300 quid, told them to stuff it how do i get round this. cos they told me it was in my credit agreement about dupilcate charges
  • Hi, hope someone can help me, has enyone had this happen to them, sent all my letters got to mcol bit, did that lst night 15/04/07, also mailed internet bank couple of times, got reply this morning usual we're looking into it, so i mailed back to let them know claiming through courts. Went to check for another reply and my online banking has been locked, I've passed all security checks but they just keep telling me can't help need to go into branch, i totally rely on online bank for transfers n everything, and they know that, seems to me they palying a 'we'll show you' game!! Surly they can't do this, I'm not overdrawn at all and haven't been for months now but that's because I'm on there 3 or 4 times a day checking n transferring etc, bit scared about going to branch n got to take 2 small children with me so concentration will not be at its best, any ideas anyone? :eek:

    Dont request statements. You need to write a letter stating you are making a Subject Access Request (SAR) under the Data Protection Act and require 6 years full details of charges to your account. The statutory fee is £10 but I have seen elsewhere that Barclays dont charge this. You can enclose a cheque or postal order for the £10 fee just in case but it will be returned to you if not needed.
  • Hi can anyone help.I filed a claim against tsb with mcol.tsb have not acknowledged claim.The letter from mcol said they had until 15 April (yesterday).Today i have tried to claim judgement by default but the system wont let me.Am I doing it correctly?
