Reclaim Unfair Bank Charges Discussion Area

  • managed to speak to a senior advisor at the call centre as the dedicated line is constantly engaged! (I wonder why?). She has asked me to hold fire on filing a claim until Monday as she wants to speak with the customer experience team on Monday morning to ask them to settle out of court!!
    She also said that if she has no joy herself on Monday, she will ring me personally and wouldn't blame me for progressing through the small claims track!
    Once again, I'll let you know.

    Well, I got the phone call this morning telling me that they have now elevated my complaint to a level 2!!!!! And, they promised me they would contact me again in 56 days (how nice of them). I got put through to the relevant department and spoke to a lady who was grateful that I was giving them a chance to deal with this situation without going to court.

    Guess what..... she said they are not prepared to negotiate and their decision is final!!! And I thought I was mad!

    So, it's off to court we go:rotfl:
  • i have received only 12 months of statements.. can i go ahead and claim these charges, and file another claim when i receive the rest or should i wait till i have got all statements and ask for a final sum:confused:

    Recovered MOST of my statements (luckily, im a horder) from 2001 - 2007 tallied up £1.097 on one and £3.086 on the other just from the statements i had.
    Seeing as the amount to recover is alot i rang the bank and asked for them to send me ALL my statements as quite obviously there are many more £'s i have paid to my bank to which i am entitled to reclaim and afterall every penny counts.
    I was told that there is a massive delay in sending out statements and is about a 2 week delay, thought i would save alarm and said my accountant is requesting them over a tax issue, to then be told that 'oh, ok, i will process as urgent' amazing i thought, funny how helpful they are when they suddenly think your NOT suing them but SOMEONE ELSE is suing you!
    Statements should be with me within a week.

    One thing i am not sure of is working out the interest, would be grateful if someone could advise how i do that please, is it the final amount at 8% ?

    I have spent most of the day reading through the success stories and advise and feel positive and confident that i WILL recover MY money.
    I will keep you posted of any further progressions.

    i have received the standard 8 week letter from halifax stating they have 8 weeks to investigate my compliant using the fsa ruling

    i returned a court proceedings letter on the 2nd april stating i will commence court action in 14 days

    today is 14 days since giving them the notification of my actions

    i have rung nicely to see what they had to say as with regards to my letter and they said it was put to side as they were within their 8 weeks!

    so tomorrow looks like a visit to mcol is on the cards am i doing the right thing please help:confused:
  • I started my claim in June 2006 and after an offer of £223 from Halifax, I declined and rang Customer Relations Head Office. Began the process with them and after a couple more days of arguing about final settlement figure they agreed to pay back £1,000 from the full amount of £1,600. If I had known about Martin's website at that time would have held out, but used the "Which" template at the time.

    They wrote back saying "this was a full and final settlement" and paid the money in at the beginning of August, i.e. £1,000 not £1,600 which was the amount owed.

    Can I now go back for the remainder of the charges as I did not claim interest and what is the legal wording required for this? Also since this time, I have had further charges at least 6 x £39 over the 6 months. I have rung Halifax head office and have had to argue with a few of the advisers and at least 3 of the charges have been refunded but not the other 3.

    I am about to write in and ask for these charges, also I've since found out that I am able to claim a refund at the time I was receiving benefits and it was actually illegal for them to take charges out of my benefits.

    I am about to reclaim charges from the following also:

    Capital One
    Monument

    Not sure how difficult these organisations will be, I understand that Credit Card Companies do tend to dig their heels in more than the banks.

    Has anyone had any dealing with Capital One and Monument and how easy/difficult was it to get the money back from them.

    I'm also going to tackle, Black Horse for a "large amount going back a number of years".

    Not sure how these other Organsations (not banks) respond and how difficult they can be.

    any advice?

    Go to Martin's article on re-claiming bank charges on the home page of this site. He takes you through the various stages of re-claiming and there is a calculator which works out the 8% interest. No, it's not a total of 8% of the charges, it depends on when the charge was taken out and how it much it was for. All you have to do with the calculator is enter the amount and date of each charge and it produces a final schedule for you which you can print out and save in Word.icon7.gif

    i recieved the same standard "we've recieved your complaint" letter and carried on with my timescale and filed with MCO anyway.
    halifax: settled paid £2622.18:j
    lloyds tsb: £1038.83 inc interest, but claim on hold.
  • I've tried looking for this information re claims under Scottish law.

    I've a claim of just over £8,000 with the Alliance and Leicester, but the advice in most of these cases are to go through the Small Claims process in Scotland which limits the claim to £750.

    What do I need to do should I need to proceed with court action against the Alliance and Leicester for the £8k i'm claiming back?

    Any help would be appreciated.

    on the 25/02/07 i sent my first letter and £10 cheque to bank, i have received since then 14 months of statements. i contacted them today and asked about the other 5 years of statements and was told that i should receive them by the 12/05/07. now i thought i should have received all six years of statements within the first 40 days, if i am right is there someone i can complain to
