Hi, I'm almost at the end of my 2nd claim from HSBC. They were served on 14th march and they acknowledged which meant that they had 28 days. Today is the last day and they haven't defended.
Do I go into moneyclaim now and ask for judgement by default or do I have to wait til yomorrow so that I'm on the 29th day?
Haven't had to do this before!

can you still claim if
last year the bank took me over drawn again and i couldn't repay so they sent me a letter and we worked out that if i pay x amount of money a month.
i would pay it back
since then i havn't used my account (Dec 06) i still have my account numbers and i can still phone them with my number and security password and speak to someone. they havn't told me that my account is closed but what i want to know is can i still claim from them (not sure ) i have however sent the first template letter with the £10 cheque but it's coming up to the end of 40days and still no reply i have rung the bank to speak to someone but can not get through can someone give me some info

Yes you can claim charges back from this account and even if it was closed you would still be able to do so. If you havent received your details after the 40 days is up you can file complaint to the Information Commissioner about the breach of your rights under the Data Protection Act. Good luck0 -
hello, is there any one out there who may be able to help?, i have sent letters to my bank and credit card, to which i am awaiting a reply. Two years ago, we couldn't pay our overdraft, i wanted them to lower it monthly, like two hundred a month, they said no and told us a consolidation loan is best. We are now paying 117 per month for this, if they had let me pay off my overdraft i wouldn't have this loan, do you think i could claim for this loan they made us have?

Hi Guys...been waiting on Halifax had to wait over the 40 days for my statements but got them eventually my total claim is £4000 with interest i have been speaking to them by telephone and they have advised i will be contacted by telephone no later than the 16th April, however, my total claim going back 6 years is for £5000 including interest so going to chance my arm as i stay in Scotland...started my claim on 1st Febuary 2007

Started my claim with the royal same date for a total of £987 got a letter 5 weeks later offering full amount, however, recieved another 2 charges in the meantime so accepted on the understanding these 2 charges would be paid aswell 5 days later full amount paid into my bank account...
My Moral is i have sent no letters to HBOS due to the fact i was unsure of the exact amount and as the 16th is on Monday anyway i will wait until they contact me if this is not acceptable to me can i go straight to court action and how do i do this in Scotland is it easy as i am totally lost..
+ 1 last thing been reading even when people are winning there claim money taking forever to get into there accounts and 1 person had there account closed i have 2 HBOS accounts and 1 of them is now closed as i was overdrawn by just under £300 but wait for it this was overdrawn by

therefore on one of many discussions with there Customer Relations dept they have stated although they have closed the account a Default notice has been registered against me and the only way this can be removed is to pay them this money back i then stated i have not claimed these as i did not pay them they then stated claim then back and then pay them to us and you wont loose any money if i win my case can i start legal proceedings for them applying a default notice against me...
Man that took ages sorry for the big long story but i feel if people tell there story in full others can learn from it.

need help please
life at a low point at mo
been claiming 2 claims with barclays
one in my own name for my own account
one in my partners name for joint
alltogether claiming approx £4,000.00 including interest
right heres where it gets strange
the claim in my own name they havent responded to at all and iv sent the first three letters next step claiming via court
joint account caliming in my partners name, they have been responding to this to me not my partner when i brought this up via a phone call have now changed it back to my partner, due to close bearvement in march have alowed them to go to their deadline which was today 11/04/07 not my own which was weeks ago.recieved a letter today from them to my partner saying the same as last letter been passed to head office and will respond but by may now
i know it's time to go to court but im a bit concerned as we have 2 loans and an overdraft still oweing with them. we no longer bank with barclays and due to unemployment are paying them £2.00 per month on each, we still owe a total of £5,000.00
can they call it all in?
i was hoping to use the joint claim to pay off the loans etc with them at a reduced figure. i did try to settle back last yr when i cashed in my endowment, but could only go to £2.000.00 they wanted £2.400.00 which is the amount the joint claim is for now
can i do this even though i am claiming another £1.500.00 for my own account?
and also can i do this even though i could end up taking them to court?
and could the problems im experiencing be because we have debts owing to them?
nothing i do is ever straight forward but i always responded to them when they have written to me about my debt to them so i expect the same back.
any help will be great just so i know im doing the right thing

I am trying to claim my charges from a credit card I had a few years ago. It was a providian card, and the account was passed to Cabot financial. As I have no statements, and I couldnt find a website for Providian, I emailed Cabot to see if they had changed their name, which they have to Monument. I have asked Cabot if I can get my statements, to which they replied that they would need to know why I need the statements, now I am not sure if I have to tell them why I want the statements, and I am not sure, if I am sucessful, who the money would come from? I am very confused! Any help would be greatly appericated!

Hi,
I've started my claim against Abbey for £1900 inc. interest and have just sent in the allocation questionaire.
Then it occurred to me that I had 2 store cards with Allders (ikano) and Marks & Spencer. These are now closed but I incurred charges before I was able to settle the accounts.
I've read the 3 major websites extensively since Dec. and do not recall seeing anything about store cards or indeed any data protection addresses etc.

The bulk of my statements I have printed off are from my online banking. On these statements it says:The personal data on this statement was correct at the time of printing. This statement is not and official Bank copy
What does that mean?? It's off their 'official' online banking service! Surely I can use these in court if necessary??0
