    i sent my first letter with a 10pound check in it, they sent me the check back and said they would be happy to do it with out cost at this time, but a few days later they sent me another letter to say i had to pay £5 be for they can authorise my statments to me, so i went to my local halifax and paid them the £5 to make sure i got a reciept, and to authorise it, still waited 2wks, went doen again to ask about my statements, they said they didnt get the authorisation, so when i produced the reciept and the letter they sent, they couldnt argue, my staements came 3 days after, dont let them stall you, keep to your time scale. good look.:beer:

    Well, I have done it. Have just issued the court proceedings through MCOL. Cost me £250 though due to the size of my claim, but it is in the hands of the court now and dependant on whether First Direct choose to defend or not (hopefully not). Have to keep my fingers, toes and everything else crossed now and hope for the happy outcome that so many others have experienced.

    Hi , i have a thread on the lloyds tsb thread but I am desperate for some guidance .
    I wrote to Lloyds asking for details of charges over last 6 years , should that have been 5 years . They sent back all the detail on both our accounts totalling some 4.5k . They also asked if i wanted to reclaim and to give them 40 days blah blah . I aid yes but didnt give any calculations .
    They wrote back with a computer generated letter saying basically hard luck .
    I have since used Martins calcuator and detailed all charges , plus interest .
    I have drafted up e leter ,attached all charges and suggested that for quick settlement I would accept 75% of total as long as they neet my request in 14 days .
    I have not posted the letter yet as this SCOTLAND rule on small claims @ £750 max is bothering me !!
    I have not mentioned court action in this letter as I felt my initial request was un detailed .
    Any thougts or advice please thanks deeks67

    Don't worry about the court stage as yet, put in your claim and if they won't make an offer in due time you can always place your claim with the Financial Ombudsman rather than going through the Scottish court system.
  • Have started the first part of my claim against them today. (sent off for 3 years statements) Such a long way to go compared to some of you. But what do I have to loose they closed my account in January, so now bank with Lloyds (basic account). I owe them £2500 off which £1500 is bank charges, unpaid DD, cheques, interest, letters to inform you your account is over its limit. Will probably be back on here real soon asking for advice especially from people who have dealt with barclays. Anybody here dealt with Barclaycard and Monument for the same sort of thing???

    for bank charges of £3,777.50
    interest £626.54
    total reclaiming: £4,404.04

    this is how my particulars of claim has been filled out
    is this correct

    i main detail i need to know are correct are the highlited ones in red

    1. The Claimant has an account xxxxxxxx
    with the Defendant, opened around 1995 2.
    Since 01/11/2000 the Defendant debited
    charges and interest in respect of
    purported breaches of contract. 3.
    Defendant is aware of all details as a list
    of charges has already been supplied.
    Another copy will be sent. 4. Claimant
    contends: (a) The charges exceed the
    Defendant's losses caused by the breaches;
    (b) The Term permitting the Defendant to
    levy such charges is unenforceable under
    the Unfair Terms in Consumer Contracts
    Regulations 1999, Unfair Contract Terms Act
    1977 and at Common Law. 5. Claimant claims:
    (a) return of the amounts debited of
    £3,777.50; (b) Interest per S.69 County
    Courts Act 1984 of 8% - £626.54 continuing
    at 8% until judgment or settlement at a
    daily rate of £0.02
    ; 6. Alternatively, if
    the charges are a fee for a service, then
    they must be reasonable under S.15 of the
    Supply of Goods and Services Act 1982. 7.
    Costs allowed by the Court.
  • I have done everything advised to me buy this site, however Natwest still keep only sending me the last eight months worth of statements even though I have had this account for over 15 year's now. I have not changed account number's or branches, the template letter was used word for word with the money enclosed. What do I do now?
  • Hi all

    Just wondered if there is any news/advice regarding whether we can claim back on charges beyond 6 years?

    For some bizarre reason, i kept my old Abbey National account statments from 1990 until 1999 and upon checking, i have worked out that charges + interest come to just shy of £500!!

    Seeing as I am on a DMP, 500 pound would be a big help right now! (And i can photocopy my statments as proof) :)

    Any thought?
