    Thanks Twinkly. I had seen some of the success stories against First Direct, but in all the cases I saw on the threads, the amounts claimed back were a lot smaller than what I am about to claim for (£8187.46), so made the assumption that they would not be so ready to pay up on such an amount.

    However, as said, I'm about to file my claim at MCOL so hopefully I should get a response from them this time. I was disappointed that they declined to even answer my second letter though !!

    Smile: Claimed £3124 Paid: £3124

    First Direct: Claimed £8178 Paid: Court date 14th Aug

    Its always possible it is in the middle of a HUGE pile of correspondence still waiting to be dealt with. Their caseloads are not your problem though. Good luck :)

    Hi Twinkly - sorry to address this to you personally but you seem to know your stuff here!!!!

    Can you offer any advise on answering NatWest Solicitors Cobbetts. They have sent a defence and request for further information. Do you know can I simply return copies of the information already provided to Nat West or do I have to answer their questions - which are very legally termed! - individually? Appreciate any help you may be able to give - thanks JG
    Nat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!

    HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.

    Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA

    Help and Advice, reqiured

    Our claim to the Natwest for £5042 originates back to December 06.
    So i followed and used Martins template letters, i recieved an standard issue letter from Natwest, explaining they have 8 weeks to deal with such matters, so i waited......Still nothing, so after lots of phone calls to them, and false promises from them of offers being in the post, i decided to use the Moneyclaim site.

    As my claim was over the £5000, the moneyclaim was due to cost £250, which i dont have. I wrote to the Natwest explaining i would be prepared to lower my claim to £3500. Had no responce from them.
    So i finaly went through Moneyclaim, but only for the £3500, i have recieved all paper work from them....and the deadline for Natwest is Today 11th April..

    So my question is...
    As i have recieved my post for the day and had no responce from Natwest again, How long does this "Judgement by Default" take???? and has anyone else been down this road??

    hi just wanting to know if anyone can help me? the thing is i'm now up to the court bit with lloyds and i had one letter saying it would be tomorrow if would be at court now i have got another one this morning from the court say this:-

    "the defendant responded to the claim indicating an intention to defend all of the claim."

    then it goes on to say the y have 28 days. i really don't understand what all this means please can someone explain it to me

    Hi Elly2007, I think you and I are at the same stage???
    I got my letter this morning...as I understand it..the bank has another 14days now, that being 28 in total from being served, to respond with a defense. Then a hearing date will be set.

  • I have an account with the bank wich has a bills acount running off it,do i have to send 2 letters reclaiming my bank charges or can i do this on the 1 letter.The 2 accounts have diffrent no,s :confused:

    Hi jayneg, its fine to address me personally but I dont always know the answers. I can but try. With regard to their request for further information send this to them as the bank apparently dont give them all the information they need for whatever reason. As to answering their questions I dont know if you are obliged to this. You have already set out your claim for the court but perhaps someone else can advise exactly this point. Good luck :)

    Thanks for your advice. I am going to start my claim against Barclays today. I have Barclays Bank, Barclaycard and Monument (a sister company off Barclays) should be fun. Anybody else on here have any luck with credit cards companies. I myself personally think their charges are worse than the bank's, but that might be because mine is a Barclays Graduate Account.
