    I had been chasing up MBNA on behalf of a friend and his default charges on
    his credit card. His charges were £389, he was offered £30 in full settlement
    which he obviously rejected. Court papers were prepared and sent off, he had
    given them more than enought time to settle. One day after MCOL were used
    a letter was received offering the original balance of £359, too late !!
    However, the reason for this entry, well I found it interesting was what MBNA
    wrote -
    "The way in which we calculate our default fees is confidential and contains business sensitive information, which could not be disclosed to the public domain."

    What a shame that they don't just pay up and stop wasting our time. The
    other comment I found interesting is that they regard our claims for the
    return of unauthorised default charges as a - complaint. I don't recollect
    making any complaint !!

    I am in the process of a claim with HSBC for £1913 & issued MCOL on 28th March.

    They have written today with an offer of £1525 :j , but challenging 2 charges totalling £80 (which ok I accept!) which still leaves a total claim of 1953.82 (this figure now including the £120 MCOL costs).

    They are also challenging the interest (obviously!) & make no reference to the MCOL fees.

    My Q is this ..... should I write back saying 'no deal' & accept the reduction of £80 but request ALL of the remainder, or should I just leave it, as MCOL have 2 weeks left & see if they offer the full amount (less disputed charges, but + MCOL charges & Interest?????) :confused:

    My view is that it is FULL payback time for the banks & the £428 the offer is short should be in my account & not left in thiers!!!!! :mad:

    If somebody could clarify some points - I would be very appreciative.

    1). Sent the first letter template to Barclays - 40 days have expired.

    2). Followed up with phone call - operator suggested she could send out six years worth of statements as they (Barclays) can't supply a comprehensive list of charges (Rubbish, but no point arguing with lady on the end of a telephone).

    3). Operator suggested this address to send another letter:

    Barclays Bank Plc.
    Leicster
    LE87 2BB

    Point 1 - I mucked up, didn't send the letter recorded and to local branch only.

    Point 2 - Are the bank in breach of the data protection act? Is it worth sending the letter again with another cheque (they didn't cash the first) requesting the information under the DPA? (Leads onto Point 3) - or is it easier just to go through my statements?

    Point 3 - Is this the correct address, as I've searched the forums and there seems to be another address although it was posted over a year ago:

  • Today is day 28 from receipt of acknowledgement that the court papers had been served. On day 14 I checked and Barclays had Acknowledged and today being day 28 I have checked and told that they are defending the whole amount, and that I cannot continue on line. Do I now get stacks of official papers from the courts - if so are they going to be difficult to fill in without the help of a solicitor? I assume it will be transferred to my local court from Northampton. Anyone have any idea how long this process takes?

    And finally, I am terrified that someone is going to be taken all the way, and that this could be me! I have followed all the templates and procedures. I am claiming nearly £4,500 from them. If Barclays don't take it all the way, who informs me of this - them or the courts?

    Many thanks in advance. I am getting very nervous, and my hubby is only just starting, waiting for his statements, and he is convinced that neither of us will get anything. :confused:
  • Hi, I have just joined the site today with a view to try and claim back unfair bank charges from Abbey (from 5 years ago) and currently Barclays and maybe credit cards. After reading through your various posts would you say it is best to approach the banks yourself using one off the templates or would you say use one of the companies that advertise in local press. I estimate my charges are approximately £2500. Barclays have closed my bank account through going over overdraft limit but their bank charges have been horrific charging me for letters I have never received plus for a returned cheque. I have not contacted them to arrange payback and I thought it best not too just in case I do take them to court, because then that would be like I agree to their charges. Can anyone help?

    use the templates off this site don't even touch these companies they will rip you off big time you can do it all yourself just follow the guide lines on the site

    Did you use the letter from this site? If not, you need to dowload the 1st letter (see homepage/ reclaim your bank charges section). They can charge you £5 for your statements, but on the template letter you are asking for a list of charges, no statements - although that is what you ususaly get.

    Hi all here..new to chat boards, and here of course..so be gentle!
    Noticed Penny 187..I am currently attacking Barclays for £2500...and today had notice that they are 'defending all of the claim' nice official form came in the post today, gave me the jitters I can tell you. I have to jitter for another 28days now! From what I have read on the forum..this is typical Barclays, and I am likely to be taken to a court date before they crack (or I do)...anyone here got any comforting info for me at this jittery time

    You *should* now receive a copy of the banks defence and an Allocation Questionnaire in the post soon now to be completed and returned to the court with a further £100 fee payable, if you are eligible for fees. The case will now be transferred to your local court. You dont need a solicitor and for guidance on completing this please see post #8 (thanks to Rex_Mundi) in the Reclaim Bank Charges Help thread here:

    I should point out there have been recent cases posted on this forum where the judge is striking out the need for this questionnaire and apparently it is because they are fed up with the banks not turning up at court so you may not have to do this at all.

    They will more than likely make you an offer of settlement at some point before the court date is set and possibly even right up to an hour before you are due to go into court. Accept nothing less than the full amount & interest & court costs now.

    She went to court against Barclays on the 5th March and they didnt turn up so she details what went on in the actual courtroom. Its very reassuring so try not to be so worried, you've got this far and its a hop, skip and a jump to the finish line now. I wish you and your husband best of luck :)
