they say " I am prepared to credit your account with the difference between the charges that you have incurred and the £12 fee recommended by the OFT" do i take the offer? or i ask the full amont?
The £12 figure is only a recommendation by the OFT but in court it is a matter of law and the credit card companies do know this. They rely on the fact that you may not. You can claim for the full amount.
Put it in writing, recorded delivery of course, that you will accept their offer as partial settlement without prejudice (that bit is important) and will continue to claim the remainder in court if neccessary.0 -
i have sent for statements from the halifax - had to write twice as they only sent 4 months of each year at first.
i have made no phonecalls and dont intend to - i am doing everything by letter.

Phone them to say you have the original date on the letters you sent them for your 6 yrs statment, keep your time scale, you will recive a standerd letter, to deal with your complaint, which takes 4 to 8wks, but keep to your time scale of 14 days, send your 2nd letter by record delivery, hopfully it wont come to your third, but if it does, make sure to send yr 3rd by recorderd delivery, so if they say they have not yet recieved your corrispondence, you can prove it. good luck:A :A :A0 -

You may not have had a reply because they are simply snowed under with such letters reclaiming charges. Did you send by recorded delivery and can prove they received it ? If not take a copy of the first letter into your local branch and get a signed receipt for it and from then on send all post recorded delivery and stick to the timescales laid out here, not the banks. Some help required regarding SAR and 40 days etc. etc.
I have received a list of charges (within 40 days) from the bank BUT they include a cover letter explaining that statements before September 2001 are archived and therefore, if I want them (And I do!) I must return the letter and wait up to a further 40 days for those statements.
Question is this: Do I have any reasonable comeback in terms of Lloyds not having fulfilled my request although happily taking another 10 pounds ?
And, what should I write back to them ? (where have all the templates gone ?!)

I assume that since you want statements prior to 2001 you are claiming further back than the usual 6 years. The Information Commissioner has deemed microfiche (archived) records to be a relevant filing system for the purpose of data provision as per a SAR under the Data Protection Act. Therefore if you stated clearly in your initial request that you required this information prior to 2001 then you do not have to wait another 40 days. They must get you that information ASAP and should have provided it with the rest of the information. Delay due to archived material is not your concern, it is theirs. Good luck0 -

Hi this is the first time i have posted anything anywere lol
but i would like to ask
i have sent my second letter asking for my money back and got to letter since saying they were looking in to it, but that was over 2 weeks ago, do i have to wait now or can i push them are they just fobing me off now.
Please help me im lost in all this and they owe me 6969.78 plus interest (the theives) lol0 -
I know this is a really busy site and a bril one too! But can anyone answer my question put on yesterday as getting quite worried as I need to reply to Cobbetts in Manchester, solicitors for Nat West, who have sent me a defence and request for further information - loads of paperwork with very legal sounding wording! Has anyone had this and if so how is the best way to reply to their questions re:CPR part 18 etc!!! Dont want to mess up now! Would appreciate ANY help on this. I seem to remember way back seeing something from Edinburgh Glass about writing to the solicitors/court about this being intimidatory - but was only at the beginning of my claim then and didnt take too much notice. Would this still be on a thread somewhere? JGNat West - MCOL March - FatWest defended - hearing date 4 July - 2300 claimed and still having charges put onto account!!
HSBC - sent 14 day - still waiting for reply. MCOL by end of week - claiming 795 - eventually paid out £560.
Halifax - sent for statements Feb - cheque cashed - nothing received - reported to FSA - paid up almost amount claimed before official complaint registered with FSA0 -

Could really do with some advice right now. My Halifax bank account is in Belfast and I've made an online claim for £490 against Halifax through the Northern Ireland Courts Service. I used the registered office address at Trinity Road, Halifax. Now I've received a letter from the NI Courts Service pointing out that it will take longer to serve the claim because it's in England, and that, if successful, I can only enforce a decree through the courts in England/Wales. What should I do?
Should I go ahead with the current claim through the Northern Ireland Court Service and hope Halifax pay up without my needing to enforce a successful decree (assuming I get one)? Should I ask the Court Service to amend my claim to serve it against my local bank branch in Belfast? Or should I start again from scratch and try and serve the claim using MCOL for England/Wales and sticking with Halifax's registered office address for service?
