  • Just a quick question from a newcomer. Been reading threads on claiming through Financial Ombudsman (Lloyds TSB actually suggested this in their letter). If I don't get any joy with them can I still claim through County Court for bank charges. Would be very grateful if someone could advise before I write back to Lloyds. Cheers!
  • hi everyone don't know if i'm in the right area but maybe you could help, won my case against nationwide asked for judgement on line, was asked how i wanted to be repaid told court immedietly, just got letter through door "judgement is rejected, a baron judgement/enforcement is in place-contact CCBC" can anyone help? who are CCBC?

    CCBC = County Court Bulk Centre. Contact the court to find out what is going on :)

    Edit: Having just had a quick read through it myself I see the FO dont always get all the money awarded and court is probably your better option for this.

    In the event that you arent satisfied with any outcome you can still go on to court. It is a case of using either/or really and the choice is yours. Good luck :)
  • Hi - I can't find how to start a new question so hope I have done this correctly by using the quick reply.

    Can some one please help me on this one.

    I sent the 2nd letter giving the bank 14 days to reply and did not receive a reply until 28th the letter was sent by the bank on 26th. This was one day later than expected and I had already entered into court proceedings and paid my £120.

    The letter I received from First Direct made me an offer of the full amount less the interest. Which I would have settled for! They gave me 10 working days to reply.

    First Direct have now been served and have entered an acknowledgement which gives them 28days to complete a Defence.

    What happens now? Can I cancel the matter and sign the offer still? as I am in fact now going to court for only the interest - would the courts look favourably upon this?

    Also I started this matter at the end of January, and have been very prompt with all the dates. I am on holiday from 22 May to 7 June what happens if this case is listed whilst I am out of the country?

    I also saw on GMTV that there is possibly a court case going ahead on Friday. What would this mean to me if the individuals wins and what if he loses and costs are awarded. Would it mean that I may have to pay the Banks costs in full?

    looking for help sent of first letter to abbey middle of feb,got a letter yesterday saying that i had filed complaint 4 weeks ago and that they had another 4 weeks to get back to me.phoned abbey yesterday as it was 41 days since they got 1st letter.i havent received statements or anything and as of today it is 42 days.could someone please advice me of what to do.thanx.
  • I have just received an offer from Barclays of £1495.00 (requested £2,240.00). I called and they are unable to negotiate over the phone (unlike Halifax which did with both my Mum and my sister favourably and in just 2 wks from begining to end). I replied in writing and requested the full amount informing them since my initial claim in January I have incurred a further £200+ but am willing to settle for the original amount requested (£2240.00). I received another letter refusing to pay anymore than the original offer. So now I have two choices;
    1) take the offer and reclaim feb/Mar and April or
    2) take em to court!!!

    This morning I felt generous and called the number given on the offer letter. I was told in no uncertain terms there would be no further negotiations and the next step would be to register my claim with HMCS (this was strange advice as the letter states 'our aim is to resolve all complaints internally, although we recognise this may not always be possible. If we are unable to agree a way forward you may be able to ask the Financial Ombudsman Service to review your complaint. We will help you if you would like to do this; however, I hope we can resolve matters for you before you take this step[/I][/I]) - which I have tried to do yesterday and again this morning. Have we jammed the online court service - the site is currently unable to process my new claim!!!!!! With this in mind and not wanting to loose my momentum, I got onto the very useful Financial Ombudsman web site, completed a claim form, signed and sent it to them. The web site is really good.     I have registered claim online with HMCS for £8,000 with Natwest (this cost £220) and waited with baited breath for them to respond with 14 day - which unfortunately they did (was hoping for a win by default). Natwest claim they are going to put in a defence and now I have a further 28 days from point of service. That should take me up to the end of April ish as not sure what date the point of service was......

    In the mean time my friend has just receieved a rather cheeky (if not insulting!!) offer from Abbey National of £180.00 for a requested £1700 - she called and refused the offer and now it is to be passed to ''stage 2''. They have already deposited the money into her bank without informing her! I will suggest that she also writes to the FOS before claiming on line and potentially saving a court fee of around £120.00
  • if the judge enters judgement against the banks does that make case law or do the banks have to turn up for that

    I should point out there have been recent cases posted on this forum where the judge is striking out the need for this questionnaire and apparently it is because they are fed up with the banks not turning up at court so you may not have to do this at all.

    They will more than likely make you an offer of settlement at some point before the court date is set and possibly even right up to an hour before you are due to go into court. Accept nothing less than the full amount & interest & court costs now.

    She went to court against Barclays on the 5th March and they didnt turn up so she details what went on in the actual courtroom. Its very reassuring so try not to be so worried, you've got this far and its a hop, skip and a jump to the finish line now. I wish you and your husband best of luck :)

    Thanks so much for that. I feel much better, but am surprised that Barclays (and others) are allowed continue to waste the Courts' time. They must be getting really hacked off with all of this. Is the second £100 refundable? If so, do you have to apply to the courts before hand and add this on? Also, can you add on charges levied since putting the original court papers through at this stage? Since taking them to Court, Barclays have got very nasty, bouncing direct debits and charging £35 per time (sometimes twice for the same D/D), plus a further 3 months at £90 a month over the limit charges.

    As always, your help is much appreciated. Perhaps when it comes to my hubby's turn (and soon my daughter's against HSBC), I will be in a position of knowledge and experience. :T
