yes go with court action.
i cant understand why folk get scared when theres a million people out there doing the same - read around these web pages- your not the 1st and wont be the last - and if you have read sucess stories you will see nearly everyone had to go to the court stage.
nothing to be scared of - i filed with court on 4th april and i am excited asit means i'll see my 3grand in the coming weeks0 -
My 14 days were up yesterday from my second letter but decided as we had 2 bank holidays to give the Yorkshire Bank a couple of days grace (after receiving a letter saying they were investigating my complaint!!
Anyway today I have received a letter from them say:
"I refer to your recent letter. I note from your letter that you feel excessive charges were applied to your bank account during recent years.
During this time, the relationship between you and the Bank was goverened bt the Bank's standard terms and conditions. Those terms and conditions provided that:
Quotes 8 T&C 's of which I wont bore you with.
Goes on and on and then says.
Taking all of the above into account and having regard to the information that you have given , I am not prepared to refund the charges on your account.

Thanks Missc, I think it is just a bit daunting to think I have to go to court with a bank! I am excited too as I want my money :-).

It's natural to feel scared when you are starting legal action against an organisation the size of Lloyds TSB. I am claiming £440 from them and getting closer to my 'pay up or I'll sue' date and it is daunting but also exciting in a strange sort of way.[FONT="]I am a Travel Agent [/FONT][FONT="]My company’s ATOL/ABTA numbers are E7760/3970. To all those awaiting statements from LLoyds TSB - if you have an online account you can get your statements for free - just download them , print them off and wawy you go - admittedly they only go back 5 1/2 years but still its better than waiting for them to get their act together - and you can always adjust your figure when you geet to court.LBM 22nd February 2007 - Amount in debt £72,242.23:confused: one month on :rolleyes: £63,900;) 2nd month 60,000.09

I wrote to the Lloyds TSB many months ago asking them to repay the charges they had 'Stolen' from my account. The initialy wrote back saying, it was all in the contract and the charges were fair etc. I then wrote to them again folloing Martin's comments on TV regarding this. I threatened court action. I followed up that letter with another advising that if they had not repaid the charges by a certain date I would have no option but to initiate court action against them. They have written back saying that as I had issued court proceedings (which I had not yet done), they would no longer be dealing with the matter as it is in the hands of their solicitor. It seems they are calling my bluff, " OK Mr C, take us to Court". I wonder has anyone else recieved this type of letter and also, should I Issue Proceedings now? My claim is for just over £1000. Any help would be great.0

Start the court proceedings now as you have told them you will.0

Just one more thing, where should I sue them, in other words, which small claims court, my local one, the one local to my branch, ???0

Use MCOL (Moneyclaimonline.gov.uk)
You can file online, use the template on this site for the "particulars of claim" - you'll have to search for it its in a thread somewhere.
Its really straightforward.
