Yes - their breach was a "fundamental" one, so the claimant can sue for the full amount due on the contract (not just the unpaid claim).0

Right, hopefully got it in the right thread this time.
I was considering taking a contract out with Mobile Shop as we have used them in the past wthout any problems, and then I read this thread. Having read through, my general understanding is that they seem to have problems paying cash back but if you accept the vouchers deal then there are no problems. Is this roughly correct? I don't really have any problems with vouchers as we tend to spend a lot at Argos and Homebase vouchers are always useable. Having read more of this forum there don't appear to be any reliable cash back companies about at the moment so now I am totally confused!0 -
I managed to get my cashback from Mobileshop (last one a month or two ago). The last 2 I had to send reminder emails for (including mentioning that they were breaching terms and conditions) but they paid up a week or so later and I didn't have too many problems thankfully
Their cashback system with the tracking etc. is generally good. However they have definitely got slower paying. Whether this is just a stalling tactic or because they are in financial trouble I have no idea however.
I was offered a good retention deal by my network so wont be using Mobileshop this year.
I would probably look for Carphone Warehouse first were I looking for cashback again but if they weren't doing anything suitable then I wouldn't be totally averse to using Mobileshop again.0 -

No. I have been putting things on several related threads. They are being totally dishonest with their co-called price-match t&c, which were based on an absolute lie from the start but which they are now not even following. The first crop of people claiming under these (the only relevant ones for new contracts) will start breathing fire and blood in a few weeks when many of their claims are unjustifiably rejected as a result. Unless you really know and understand the intricacies of what cpw are up to you stand a 50% chance of getting getting burned. They are NOT the company they once were (by a LONG way!).0

Oh OK, actually I have just read another thread with your points on. I have a contract with E2Save but fortunately, not a price match one.
Edit: Actually as I was typing I got a text from E2Save confirming receipt of my cashback claim. Talk about conicidences!0 -
I am waiting on my first 3 cashbacks. The 4th was submitted a few days ago. I have been in to live chat and was told they are working in order of priority. Is anyone still waiting for cashback submitted feb/march? I advised if I have not received it within 14 days I'll start the moneyclaims process... Just need to wait and see now!
I'll also let you know how it goes.
** Update - Just had 2 "payment confirmation" emails saying that 1st and 2nd cashbacks will be in my account within 3-7 days. Awaiting email No. 3!!0 -
Further to my last post I thought I'd give an update.
Unfortunately only one of my three outstanding claims was paid within the timeframe I was given and I was starting to think that I'd need to update my legal letter. Today, however, I received another mail letting me know that the second of the three was being processed. Assuming the last one is processed next Tuesday all will be well. I'll let you know.0
