i am too also havin problems with cash back contract as fin and i only recieved 1 payment it is a joke you send them e mails and they reply we are having probs and to bear with them wondering if you have got any where thanks0

Do you guys recommend going through moneyclaim to get cashback on 2 contracts even though they only owe me money "so far" on just one of the contracts?
The second contract's cashback starts next month.
Also, did you guys add the £30 (court costs) to the money being claimed?0 -
If there has been no breach on your second contract, then you have no grounds for making a claim.
When you complete a moneyclaim online it automatically will add the fee you have paid onto the claim.0 -
Hi guys,
I've tried the whole legal threat and it worked for my 2nd cash back. However, for my 3rd cash back they are being extremely stubborn. I went onto live chat, spoke with Tracey) and they didn't even bother with the technical problems excuse. I wast just told they had a queue and other people were in front of me. I explained that wasn't my problem and that I would take begin legal action if the issue wasn't resolved. Tracey
said she'd pass my details onto the payment team and I then got an email back saying:

"Hi, customers are paid in a priority method due to the back log we have."
I've now sent them an email stating I'll begin legal action in 7 days, which is tomorrow.
So now I guess I'll have to send out the letter before action. I hope I don't really have to go through the small claims court but it seems that for some this is the only route.
I'll post how I get on.0 -
I am waiting on my first 3 cashbacks. The 4th was submitted a few days ago. I have been in to live chat and was told they are working in order of priority. Is anyone still waiting for cashback submitted feb/march? I advised if I have not received it within 14 days I'll start the moneyclaims process... Just need to wait and see now!
I'll also let you know how it goes.0 -
I went on to Live chat yesterday, chat log below for reference (minus identifying information). I have just had a call from them saying that all three payments have now been passed on to the payment team for processing on the next run, which is early next week. I have also just got this in an e-mail too for confirmation so it's looking good. I'll let you know how it goes.
Live chat can work then it would seem. My e-mails previously had been mostly ignored despite moneyclaim.gov threats. I'd actually just put together a letter before action too that was going to be sent today to set up for a moneyclaim so MS have come through at the right time it would seem.
I'm still not using them ever again mind.Chat_log wrote:MS: Hi, how can I help ?
Me: hi, i'm chasing up a cashback claim that remains unpaid - #####
MS: can i have your address please
Me: which address, home address at the time of order?
MS: home address
Me: when i ordered and on the cashback tracking it's:
MS: at time of order
Me: *****
Me: *****
Me: *****
Me: *****
MS: Our oldest claims are taking priority, but in this instance, I have added you to the high priority list, note padded this conversation and I assure you are moving up the payment list. Unfortunately, I am still not in a position to provide specific payment dates.
Me: ok, i've had emails in the past about the system failure etc.
Me: it's dragged on too long and without a firm payment date i will be going through the moneyclaim.gov site to go through the small claims court
MS: i will make the cashback team aware of your intentions
Me: would someone from there be able to get in touch with me today?
MS: im afraid the cash back manager leaves at 2
Me: right
Me: well, thanks for your time, i appreciate it

I know that mobileshop are a complete pain to get money "cashback" from having gone through it myself a couple of years ago. They used the same excuses then that they do now.
However was wondering if you opted for the Argos vouchers are they any good at issueing these in time?0 -
i am stuck in 3 cash back deals and i havent been paid..i have had to downgrade my contracts...can i still have a chance if i make any formal proceedings?0
-
Mop, did you downgrade during your contract? If so it invalidates your claim.
T & C's say: Airtime bills must not show any outstanding balance/arrears owed to the airtime provider and claims are subject to you remaining on the same pay monthly tariff as at the time of connection.

As long as you didn't downgrade prior to making the first claim that has not been paid, and you had stuck to the contract terms when making that claim, then you can sue for a fundamental breach of contract.0
