Well well well .. very quick response
Having fired off a courtesy e-mail informing them I had taken action and giving them the court reference number I received a phone call this morning !!!
Yep - after months of refusing to speak to me they did and told me they had raised a cheque this morning for the outstanding balance.
I told them I had already issued the summons and they said that they would eeal with it when it arrived.
However, of course I now want more than just the cheque because I need to recover my court costs?
So what happens when they get the summons and tell the court they have already paid? Will I still get my court costs back?
I guess I should be happy I've got my money (still a risk though coz the cheque has to arrive and be cashed yet of course!) but am aggrieved it took this action to solicit any kind of response.0 -

Please see below e-mail from Samantha guaranteeing payment to me between 7-10 working days. I got through to Customer Services who gave me the tale of woe regarding their system. I said that I did not believe them and even if it were true it was not my problem and I was not a partner in their problem. I said I was ringing to give them the opportunity to pay or I would instigate legal action because they were in breach of their Terms and Conditions and therefore breach of contract. The girl said she would TRY to get a payment made in 14 days. I said I wanted a guarantee and not a TRY. She said she could not guarantee so I said put me through to someone who can guarantee - I then was put through to Samantha. Samantha again wanted to tell me the tale again - I said I was not interested (politely), I just wanted my cash back - not Argos vouchers. I just want her company to honour their contract and pay me or I would instigate legal proceedings - a !!!!!!ation factor for me but I had the will and means to do so.
Her reply is self-explanatory.
I would suggest you ring them up and do the same as me.
PS - I have her direct line and e-mail address - I will release this to the forum once I have received my refund

Subject: Your overdue cashback payments
Good Afternoon Justin,
I have processed your 3 outstanding pay me nts to be account detailed and cashback amount checked and confirm that you will received pay me nt within the next 7-10days. The system will send you an automatic email as soon as the pay me nt has been processed which will be within the next couple of days.
Kind Regards,
Had this today! 3 emails in total representing the number of outstanding vouchers. Try doing what I did - I am no cleverclogs - I rang up and was firm, polite but left them in no uncertain terms that I meant business. I will let you know if the payments materialise!

I filed court action against mobile shop (they owe me £270) after loads of phone calls, letters, emails and snotty customer review comments without any response. I have now received a letter from Samantha, Cash Back Supervisor informing me that my full cashback payment plus court costs have been paid into my bank account.
I wait and hope and will keep you posted !!0 -

Once a summons issued it is best to have no contact whatsoever with the Defendant until the claim has run its course.
In your case, don't contact them again.
Once the summons is issued, they have 14 days to either pay up or issue a defence.
As long as you sent them a Letter Before Action prior to issuing the summons they have no defence to paying you the full sum claimed.
If they do not pay you the balance remaining (your costs), then you can ask for judgement against them for this sum.
I expect them to pay up during the 14 days which will conclude the matter.0 -
Yesterday I received an email saying my final cashback was being paid. This is very early as was my hubbys last one. No chasing - nothing.
Dare I chance my arm again, or call it quits ????????????????
Their T&C's have changed and can be viewed as unfair, as with everyone elses. I don't like the idea of waiting until month 6 before making a claim, they may not be around then !!!!!!!!!!!!!!!!

Part 3 of my cashback is 125 days waiting now
Part 4 is only 28 days waiting (i.e. within the 60 days)
Can I also claim for Part 4? If so what do I put in the claim form in this respect?
Put on the form that "the Defendant's failure to pay you claim 3 is a fundamental breach of the contract, and that in view of this you are claiming the total amount still owed under the original breached contract".0 -
how can i get to live chat to claim my money? any one please.Regard
