I had 2 long overdue payments and the third also claimed, had emailed mobileshop LOTS (and got the standard 'update' reply lots too) - then read another thread on here advising live chat - tried it about 3 weeks ago, mentioning that i had been advised to use the moneyclaim website - tracey simply asked me for my order number and told me she had passed it to the finance department (Saturday) - got email on Monday saying the 2 overdue payments would be made on Friday, but actually got them before that.
Now i've just received an UNPROMPTED email saying my 3rd payment will be made!
I'd certainly recommend trying the live chat, even if it takes more than 1 go, as it's really easy to do, and seems to be working for a number of people (but mention moneyclaim).0 -
emailed telling them that I have the court papers and will be taking action, also mentioned this site saying that hundreds of people are (ganging up) taking action to get our money back, and guess what !!! 2 days later I had conformation that my £90 had been deposited into my bank account. And it was.
I think that if you mention MSE they will be Shi**ing themselves and paying
out A.S.A.P. Try it, it worked for me. :j0 -

Notice now they have changed this to 512KB monthly data allowance. Glad I never went for this deal then, despite their customer service reps assuring me it was 512MB on a number of occassions.0 -
I sent them a letter via e-mail.
After not hearing anything I went on live-chat on their website, where I asked them to achnolage receipt of the e-mail. They did.
I was then informed (on here) that for it to be valid in court I would need a written letter, which I did via recorded delivery. This was about a month ago. (I've been moving house so I had to leave it). I believe this letter was recieved on 18th July 2007.
Anyway, given I have given them MORE than enough time to pay.
Please can anyone advise on how I should put in a claim. I am owed £270 in total. (although £90 of this is still within their 60 time period) - however I believe I can claim this anyway.
Anyone advise. I have been having a read about small claims proceedures. Do I put my claim in through 'Small Claims' or by 'moneyclaim'?

Moneyclaim online is the same as doing a small claim via your local county court.

If the T&C of the contract have been broken you are entitled to claim the total outstanding amount i.e. from your example that would be part 3 & 4.

Please see below e-mail from Samantha guaranteeing payment to me between 7-10 working days. I got through to Customer Services who gave me the tale of woe regarding their system. I said that I did not believe them and even if it were true it was not my problem and I was not a partner in their problem. I said I was ringing to give them the opportunity to pay or I would instigate legal action because they were in breach of their Terms and Conditions and therefore breach of contract. The girl said she would TRY to get a payment made in 14 days. I said I wanted a guarantee and not a TRY. She said she could not guarantee so I said put me through to someone who can guarantee - I then was put through to Samantha. Samantha again wanted to tell me the tale again - I said I was not interested (politely), I just wanted my cash back - not Argos vouchers. I just want her company to honour their contract and pay me or I would instigate legal proceedings - a !!!!!!ation factor for me but I had the will and means to do so.
Her reply is self-explanatory.
I would suggest you ring them up and do the same as me.
PS - I have her direct line and e-mail address - I will release this to the forum once I have received my refund
