    Has anyone been receiving confirmation emails lately to say that your cashback form has arrived at the office?

    I posted on another thread about the trouble i have had with mobileshop not paying my 2nd and 3rd cashback since february. I sent a letter to them last week recorded delivery. Within 5 days they paid both my outstanding cashback claims. I have replicated the letter (just fill in the blanks) to save others time as it seemed to do the trick!!

    Dear Sir/Madam,

    Re: Cashback No:

    I write further to my e-mails dated ___________ to which I have not received a satisfactory response.

    I understand that my 2nd Cashback claim was received by you on _______ and my 3rd Cashback claim was received by you on _________ .

    I refer to Paragraph 5 of your Terms and conditions in relation to Cashback, in which you purport to process all cashback claims within 45 days from the valid claim date.

    I am extremely concerned that my above-mentioned cashback claims remain outstanding after _____days and _________days respectively. This is clearly in breach of your Terms and Conditions and indeed your duty of care towards me as your customer.

    You will note that I have fully complied with my obligations under the Terms and Conditions relating to your cashback claims process and I am therefore extremely dissatisfied by your inability to comply with the same.

    I understand that you have recently experienced some difficulties with your cashback system, however, I should not have to suffer financial loss as a result. I have been unable to contact you by telephone since approximately April 2007 as you have prevented telephone queries through the use of a recorded message regarding the difficulties you have experienced in relation to cashback claims. My e-mails to you have either been unanswered or I have been reassured that my cashback claim will be processed immediately, to no avail.

    I entered into a contract with you in good faith and in reliance of your terms and conditions in relation to processing of my cashback claims. As a result of my reliance on this contract, I have suffered financial loss and have wasted time and effort in pursuing my claims.

    In the circumstances, I am obliged to inform you that should I not receive the full value of both my 2nd and 3rd Cash back claim within the next 10 days, I shall be pursuing legal action against you in respect of the same, without further notice to you.

    Should it become necessary for me to commence legal proceedings against you, I shall be seeking an Order that you are responsible for my costs of the same.

    Should you have any questions or queries, please do not hesitate to contact me on _________.

    I would strongly recommend that you obtain independent legal advice as to the contents of this letter and I look forward to hearing from you or your chosen legal representative within the next 10 days.

    Like others here, I too was a previous happy customer so didn't hesitate to take out another cashback deal with Mobileshop last August. Big mistake.

    1st cashback submitted in Jan., 2nd in March. Only got confirmation that 1st cashback form had been received (I always send special delivery) when I contacted customer services as tracking hadn't been updated. Then strangely after 2nd cashback submitted both were shown as tracking.:confused: Nothing since then, and I submitted my 3rd cashback about 10 days ago. Each time I emailed the cashback email address, I got the standard automated response.

    So I read up on others' experiences here. Last week Tuesday, I emailed Mobileshop on various email addresses, some found here, others (prob. inaccurate/outdated!) that I'd googled. I gave 7 days notice stating that I would then claim all 3 cashbacks and the remaining one through Money Claim online. I also copied/pasted same text into the 'contact us' and complaints forms that Mobileshop have online. (Desperate and sad!)

    I got the standard technical problems email as well as an apologetic reply from an Emily Brason responding to complaints form. Nothing since then so this moring I sent another email stating that I was now going ahead with my court action. Perhaps the cashback payments were already being actioned when I sent my email last week, but funnily enough about 3 hours later I got 2 x notification of cashback paid emails...... Ah well 2 down, 2 to go.

    So no, in my case I didn't have to go through Money Claim online, but from reading other posts some people have had to. It would seem that giving a clear deadline by which you will take action seems to spur Mobileshop on, on who they then pay cashback to (if that makes sense?)

    I used a mishmash of info I found in the forum, but I would say that had I seen it sooner I might have 'borrowed' mookiandco's template:beer: .
    Also thanks to Lynsey, thor, gsmtech, amongst the many others who've posted very useful advice and tips on how to extract cashback from Mobileshop!:T

    Waiting for 2nd and 3rd cashbacks, 2nd due end of march, 3rd due 24th Masy, last friday sent special delivery letter to them asking for payment within 7 days etc etc, which was today, and surprise , nothing, no email, nothing in bank.They did receive the letter as I checked. I have got to send in 4th cashback claim next bill, should I wait and do a moneyclaims for all of it, being as we are so close to that, or do it twice. Well cross now, can't afford to lose this morning. Is any cashback deal safe now?

    I'm pretty sure that I read somewhere on one of the mobileshop threads that if you make a claim you should go for them all even for the ones that are not yet due since it is mobileshop who are in breach of their terms and conditions. I can't say how true this is legally though.

    Yeh I'm owed cashback from mobileshop too. i fail to see how they can offer argos vouchers within 7 days, but cant offer cashback !! i've just sent them an email threatening legal action, so lets see.

    I've got to agree, not had any probs with them, yes, they take their time, but you do get your money eventually!. You guys should read the reviews on onestopphoneshop :(, they are the worst company i've had the misfortune of dealing with, they try everything not to pay at all!!!

    Just wanted to say that i got all three of cashbacks paid in one go last friday, including my most recent voucher which was sent in april 07.

    This might have been speeded up by the fact that i had two poilte (yet slightly irratating & long) converstions on their online chat feature trying to chase up my long overdue payments. But maybe there actually was just a long delay on their end & they finally sorted out their act???

    Also its worth noting that I actually did decide to go with the argos vouchers for all of my cashbacks as i had got fed with waiting, and actually sent the email to argos@mobileshop.com to confirm, its seems they just ignored this and couple of days later sent me the email saying they were gonna give me my cashback after all!

    Either way I dont think i'll be using them again. Hope this info is helpful to someone.

    I was finally paid my first cashback without having to go through moneyclaim online. Hopefully mobileshop will start adhering to its own terms and conditions for future cashback claims.

    I was paid 24 hours after I threatened to legal action. What a surprise ... NOT! This is a shame really, my contract is up for renewal soon, and now I won't be using mobileshop again.
