Maybe I should just act on my threat
Exactly, as long as everything is correct on your side. ALL out of pocket expenses will be recovered and added to your "DEBT"

MartinH, I've just noticed that you are waiting for coming up to 3 payments.
It may be worth your while waiting until your final payment is overdue and sue for all 3 payments at once. You could actually do this now if you want as MS have breached/broken the T&C's.
My account is as below and both payments so far have had to be chased up, as well as some from my previous contract with them.
Voucher A
Voucher A claim received on: 11/12/2006
You should expect to receive payment Around 60 days after we received your claim for this voucher.
Voucher A paid on: 09/02/2007 - Payment was processed into your bank account.
If after 14 days the payment is not showing in your account, contact us. (See below for contact details)
Voucher B
Voucher B claim received on: 14/02/2007
You should expect to receive payment Around 60 days after we received your claim for this voucher.
Voucher B paid on: 25/04/2007 - Payment was processed into your bank account.
If after 14 days the payment is not showing in your account, contact us. (See below for contact details)
Voucher C
Voucher C claim received on: 16/04/2007
You should expect to receive payment Around 60 days after we received your claim for this voucher.
Although Vocher A stated it was paid, it in fact wasn't and a cheque was issued after chasing it up.
Best of luck,

I tried that but am still stuck with:
A different tactic required maybe? I gave them a two week deadline to start with, which brought the standard reply about system failure/manual blah blah. Then I gave them another two weeks deadline after the first one had passed threatening to take it further using the money claim website. Still nothing and that was a few weeks back now.

Just to update you all
After the last time when my cashback was finally paid 65 days late after several threatning emails I thought I would be more aggressive this time. I must have sent a dozen emails ranging from the nice through pleading poverty to threatening action over a month all to no avail. Including several on-line chats. All were either ignored or had the standard email response (We are having triuble ....) Finaly sent them a recorded letter threatening action (copy of one in this thread) with consequential costs and got an almost reply that all my money was being paid ie one set 60 days late and the other set almost on time.
My brother gave up and accepted the Argos vouchers as he wanted a wii for the kids - got them in 7 days. Unfortunately there is nothing I need from Argos or Homebase. Maybe if they were a bit cleverer they should offer asda vouchers - would have taken those.
I suspect that they are now aggresively trying to
a) Slow their cashflow
b) Get the extra 10% saved by being able to reclaim vat on the vouchers
Looks like recorded post is the only way to shake them loose now.

Well done Stephen. Both my husbands and my cashbacks were due by Friday (yesterday) and weren't paid. Because of previous delays my husband has today sent off a recorded delivery letter giving them until 2nd July to pay both cashbacks and has informed them that once again thay have breached contracts. He has informed them that any payments received after the 2nd July will need to include costs incurred in recovering this DEBT.
No messing about this time, action will commence on the 3rd July if payments haven't been received.
I will keep you updated when I get back from my holidays.

I suggest others go down this route...It's a shame cause i wont use them again in a hurrynever put off buying a bargain today,it may be gone tomorrow0 -
Has anyone tried faxing their cashback claim?
I have posted a copy of my 1st June bill twice now, by recorded delivery each time and have not had confirmation of reciept and RM track & trace just says "Come Back Later: Recorded Signed For™ items are only tracked after the item has been delivered."
Or should I send another by special delivery? I'm running out of time!0 -

Have you tried looking on the MS website?
I don't recall RM stating that the items arrive but MS updates their online tracking that it has arrived (printout or save a copy).

Can't help with the claim unless you DO want to fork out another £4.30 for sd (even that CAN go astray I believe!). However, it seems the good old Royal Mail can;t be bothered to get signatures for recorded delivery a good deal of the time, which is extremely worrying and unfair when you've paid for what is a basic but straightforward service. It's only happened to me once so far but I complained to Royal Mail. Their complaints department is as useless and unhelpful as their customer services department, BUT they will refund the postage and the point is that if everyone complained they'd HAVE to actually try to make the service WORK or they would lose a lot of extra income. If no-one complains and asks for a refund why would they of all organisations bother?
Not much help to you now I know, but I do think it's important to try to force them to sort this problem out whether you are sending to this company or any other and relying on proof of delivery!0 -
Scan your bill and email it to customer.service@mobileshop.co.uk
It is the only thing that is good about them now and they acknowledge receipt just as if you had posted it to them. It won't cost you any money and you will know within a day or two if they have received your bill or not. Don't forget to incluse your details and cashback claim number.0
