Thanks for all your replies.
It turns out they recieved the first letter, I didn't think to check on the MS website because when they recieved my previous claim, they e-mailed me to tell me so. They didn't this time.
I thought they would send me a new link with the June cashback info, but in fact, the old link takes me to a page detailing info for all the cashbacks.
RM recorded delivery has been a bit shoddy lately, all 3 of my recent RD letters appear not to have been signed for and I received one myself that was just put through the letterbox.
Am definitely going to complain.0 -
I sent them the following letter and they paid up immediately. Also e-mailed it to cashback@mobileshop.com.

WARNING: NOTICE OF IMPENDING LEGAL ACTION – DO NOT IGNORE
15 June 2007
Dear Sir/Madam,
Mobile No.
Cashback No. – Overdue cashback claim: £105.00
I refer to the above overdue cashback claim and note that it has remained outstanding after such a long period. Despite previous live support chats with Carole on 15th and 25th May; telephone conversation with Carole again on 2nd June and subsequent written reminder on 7th June, no indications have been given as to when payment will be made.
According to paragraph 6 of your Cash Back & Reduced Line Rental Terms & Conditions (for customers who ordered between 15th May 2006 and 31st October 2006), all cash back payments will be paid within 60 days of the valid claim date. You received my valid cashback claim on 13th March 2007 which was due to be paid on 12th May 2007. This is now 34 days overdue and it appears to me that payment is still not forthcoming.
You are therefore acting seriously in breach of the abovementioned terms and conditions. I now regret to have to formally write to you and inform you that should I not receive the full value of this outstanding debt in my bank account within the next 7 days, legal proceedings will be instigated against you without further notice to you. This will result in you having to pay statutory interest on the debt from the above due date, additional legal costs with debt collectors sent to your company to seize the assets to cover all outstanding amounts once judgement has been obtained.
I suggest that you obtain legal advice in this matter or settle this outstanding debt immediately and I look forward to hearing from you within the next 7 days.
Yours faithfully,0 -

When issuing a summons for money owed by Mobileshop, DON'T issue it against a named individual.
Mobileshop is a firm (mobileshop.com limited).
If you issue a summons against the person suggested, then it will fail (as the lady mentioned does not personally owe money), and you would lose the claim and your court fee.0 -

I noticed that whilst I had one cashback on time, the other is a month overdue so emailed to ask if they could look into it.
Standard response back.
So I responded in kind with my standard, payment in seven days or SCC.
How come they can pay one on time and not others?(As in why aren't they all late?!)

pass, when I sent the letter to them last week, one claim was on day 100 and the other was on day 60

Hello all
I've just joined specifically to discuss this subject. My claims are as follows:
Voucher A
Voucher A claim received on: 26/02/2007
You should expect to receive payment Around 60 days after we received your claim for this voucher.
Voucher B
Voucher B claim received on: 09/05/2007
You should expect to receive payment Around 60 days after we received your claim for this voucher.
Whilst they are JUST within their time limit for claim B, they have clearly exceeded the limit for the first claim. Nevertheless, I'm plodding on and sending in my 3rd claim.
What will happen? I don't know. I'm not particularly heartened by the 'Customer Comments' section, where customers are waxing lyrical about how "smoothly" the cashback process has been for them. Even more annoyingly, there are those who praise MS for their "prompt" and "on time" payments, and even "before due date". Who ARE these people? And why are they getting paid and not me?
Having read the more recent entries regarding legal action, I've now arrived at the conclusion that, since they are clearly in breach of their T&Cs in respect of my first claim, this seems to be my only option and have mailed them accordingly.
If I do not hear from them within the week, I will be writing to them to formally threaten legal action. Thanks to those who have hopefully pointed me in the right direction.0 -
Just to keep everyone informed, my latest cahback is 3 weeks past the 60 day limit and no payment yet again!
I sent an e-mail giving 7 days for receipt of payment or legal action will be taken and got the standard reply about a big backlog.
This fiasco has been going on for about a year now and they have clearly shown their incompetence to deal with the problem.
So for me, a stress free life is more important than all this inconvenience and therefore will NEVER EVER deal with this company ever again.0 -
Does anyone have a copy of the letter they sent to Mobileshop that resulted in them paying up that they are willing to share?0
