i am also waiting for payment for a claim sent on 26th Jan and another sent on 12/02/07 (separate contracts).
I too have sent various emails with deadlines to pay by and have got nowhere- i have been fairly strict in the emails
I will be sending one final email and then starting proceedings to claim ALL outstanding cashbacks for the entire year as they are in breech of contract, suggest you do the same.
Not sure how far watchdog will take it and when you'd get your money0 -
Personally I'd avoid threatening that you'll contact Watchdog; the programme is very unlikely to take an interest so it's usually a toothless threat that is often seen as a sign of weakness on the part of the complainant.Toyota - 'Always a better way', avoid buying Toyota.0

Is this possible, my husband hasn't yet been paid (deadline this Friday) and they have stopped replying - he would love to take this option if available. Anyone with experience of this and could give advice would be appreciated by all.

I emailed them saying I wanted assuring that I would be paid my cashback, and if I did not receive a satisfactory answer I would be going through moneyclaim.gov.uk

We fully intend to honour all cashback outstanding – unfortunately our system is not matching the voucher to the correct bank account – so we all processing small batches manually – rather than add to this problem by paying wrong amounts to customers.
Your payment is on a high priority list and will be processed on the next run.
Are they stalling for time.

Just seen this on their web site, don't know how long it's been there though!
Unfortunately we recently experienced a major technical problem with our cashback payment system. We have since rectified the cause of the problem however we now need to ensure that the integrity of our database has not been compromised. Until this exercise is completed, we will be processing all of the cashback payments manually to ensure the right customers receive the correct cashback payment. Due to the sheer volume of customer claims, we anticipate this clearance process will take considerable time. At this point, we cannot provide specific payment dates but can assure you that your claim will be paid as soon as the backlog has been cleared. We appreciate your patience and understanding during this process and apologise for any inconvenience caused. We are making every endeavour to get your payment to you as soon as possible.
If you do wish to accelerate your claim, as an alternative to cash we would be delighted to offer you an Argos / Homebase gift card for 110% of the value of your cashback claim instead. We normally offer our customers a gift card to the value of 105% of the cashback claim but, as a gesture of goodwill and by way of compensation, we are prepared to increase this offer to 110% of the cashback claim value. I have no idea if this is possible and dont have any experience. I read a couple of threads about someone saying thats what they did (different company) and were succesful. can't find the threads now
If they are truly in breach of contract (which they can't legally deny) then it may be possible to claim ALL outstanding cashback + court fees.0 -
Thanks medic, I'll pass on the details and he can check them out. He's waiting until Friday and then will contact Consumer Direct for advice. It would be great to get all of the cashback payments in one go with only one lot of court costs. They are definately in breach of contract and he wants to check out how they stand giving the statements of "technical problems". Can he just sue, or does he have to give them a reasonable amount of time? He has already given them over 20 days on top of the 60 days they have said they will pay.

Thanks for the link grayme, I'll get him to read the info. This would be a great way to get everything finalised and he can "wash his hands" with MS. The cashback claim that hasn't been paid is his first one due of four and he doesn't want all this crap everytime, although I haven't had major problems, mainly just chasing up the last few, which shouldn't have to happen.

Please keep us posted, your husband's deadline is before mine.
The deadline i have given them is Friday 11th May 07. Sent this via email and recorded delivery letter over weekend.
With regard to a 'reasonable' time to be paid: i would say 45 days which was the original terms (perhaps add in 14 days?)
The deadline i have given them is 105 days from submission of claim- and i have sent several stern emails prior to this as well!!0
