  • Yes well done to TISME (I meant to write this last week, but..). And I have some good news too!
    PLUS MESSAGE TO mgb!!!!

    No need to mention what problems I had exactly, just the usual emails, phone calls and MobileRainbow's lame excuses and contradictions of excuses from different depts, "forwarded to concerned department" etc. Nothing, but excuses and promises of payment within 10, 15, 7, 0 days. MGB don't hold your breath with their 7-10 day promise, I've had it all! Anyway, I did the MCOL thing (it cost me £80 not £30. However, all has been recovered.) I sent MR a similar email to that of mgb on 28/03 stating that court proceeding will be initiated if payment was not made by BACS into my a/c by COB 30/04. The following week I received a back dated (26/04) cheque for my cashback the very day after MR were issued with their court claim form. Funny that, aye! I emailed them and declined presenting the cheque (for 1st of three cashbacks) and I said it'll go all the way if they didn't pay up all my cashbacks + £80 fees + £100 inconvenience comp. I then had a phone call from one of their overseas cust. serv. guys confirming I had been issued with my first CB cheque and was I happy. I told him to tell his bosses stop the crap and I'll see them in court (I was polite about it, ha ha). Very soon after that I received a letter from Msols(MR) saying they had paid the £600 claimed into my bank account. And, :eek: hey presto it's there. I have now received a form from the court asking if this is true and am I happy to stop proceedings, which I will positively complete right now. They do owe me another £45 litigation cost, which was not written into my origianal court claim, only emailed to MR at a slightly later date
    (my litigation=£25 per letter / £15 per email /£10 per telecon)and as they don't read all their emails I don't suppose they realise this. However, under the circumstances and if all of you and everyone courts-their-butt, so-to-speak, then I'm happy to wave my litigation fee.
    mgb, I do hope you read this before submitting your MCOL as you need to calculate how much the inconvenience is worth to you and tell them from now on you are charging litigation fees. They will pay, as previous stated by someone one this thread, MR don't want these things to end up in court, it'll destroy them. Plus they have the money from the many thousands that haven't bothered or missed claiming their cashbacks. Also keep sending in your cashbacks after they've paid just to cover yourself (previously mentioned by someone). I hope I've given confidence for you guys to MCOL and haven't rambled on too much, ha ha. Good luck, you shouldn't need it!

    Well it's all happening. My hubby received a cheque today for his outstanding cashback, which means he joins the very special club of ppl who have had received all their cashbacks!!!

    No money has been paid into my account, so when I go home from work tonight, I will update the claim with compensation and interest, and press that magic button.

    Thanks to all who have shared their success stories, it gives hope to the rest of us.

    An update on my case:

    I took MSols to court. They didn't reply within 14 day so I entered 'judgment by default' and the court accepted it in my favor. MSols were sent the court order to pay full amount but it's been over 2 weeks and they haven't paid or contacted me.

    Any good ideas on how I can persuade them to pay the court order?

    Update from me too.

    I had emailed them and called them with no luck, so I sent the claim form in via MCOL.

    Shock / horror they finally sent me an email disputing the fact that they received my claim. I have the royal mail delivery confirmation, and they keep asking for the number, but quite frankly I am not going to give it to them. I am quite enjoying this. I have all my proof together, and am ready and waiting to take them to court, I think a lost court case is EXACTLY what this Company needs against their name.

    Anyway, they have disputed my claim (checked online), so am now waiting on instruction from the courts as to when the hearing is. I will be getting together all my paperwork, and am ready to give these sc\/mbags what is coming to them!!

    You all seem very confident and determined which I admired! I am also in the process of claiming money from mobile rainbow. They claim that I have not sent the correct bill and therefore do not qualify for cash back. They have filled their defence denying they owe me any money.

    My problem is I have sent everything with recorded delivery and sent the original bill to them. However, I have not kept a copy of the bill. Will this be a major problem? I intend to take them to court I have checked moneyclaims online and they have filled their defence and I am now waiting to hear from the court.

    I would really appreicate any feedback and sugestions. I know mobile rainbow are adamant they dont owe me money. So very worried they will not pay and as I have no legal experience I will not be able to get my £120 which is the last cash back they owe me. They state I have sent them the 13th month bill instead of the 12th month bill.

    i think nowadays, you can print your bills from the internet...if you're with 3 network for example, they've got their 'My 3' service which is an internet portal for customers to change their contact details, billing address and view/print monthly bills

    i just dunno if an online printout is admissable in court? all the best in your endeavour nonetheless, hope you win against this bunch. God bless=)

    If you sent it recorded delivery you would have a date of arrival for the 12th month bill which given that you have only 28 days (?) to submit it, would have arrived before the 13th month bill was issued?

    The first month's bill is the one you get when you connect, so the 12th month bill would be when you have been connected eleven months...

    Instruction arrived from the court, will be putting my case together and sending all my info in, this could take some time, think it will drag on for months.

    They will not win.

    Has anyone got the latest info on the Mobile Rainbow for coughing up cashback ? I've seen some postings that suggest that there's been problems contacting them in the past although they did pay up ( late ) in the end.

    I have used the Mobile Outlet in the past who have paid up so far but both payments were late - but at least they paid up.

    Update on my case.

    After taking MSols to court and court order in my favour, I phoned Msols and asked why they still hadn't paid and mentioned that i will proceed with the warrant (sending bailiffs and police) to recover my money.
    Next day all outstanding money was paid into my account.
    Later Msols sent a message asking me to inform the Court that it was paid and that they want the reference removed from the register...

    Many thanks to Quentin and other people who offered their advice on here.
